. Mr. Lovett also gave some attention
to the Chicago & Alton affair, coatend-

In further discussion of the Chicago
A Alton transaction Mr Cravath said
the officials were pursuing a well rec-
egnized method in these transactions
of distributing money to its stockhold-
ers He pointed out that all the trans
actions carried out by the Chicago A
Alton people were well understood by
the financial interests of the country.
He asserted that there was no secret
made of the transactions, and that they
were presented fairly to the public by
all the financial agencies No Interest

have been misinformed concerning
them.
Mr. Cravath said that it was evident
that the time had come when the par
value of securities should bear a dein-
nite relation to the actual value of
those securities and that there was no
reason for the belief that the Chicago
A Alton transactions had not been con-
ducted in that view.
At the afternoon session Mr. Lovett
contended that in so far as the re-cap-
Italixatlon of the Chicago & Alen nf-2
fected the public it had resulted in a l
saving of $165,000 per annum as com- i
paied with the expenditures account
of interest and dividends made prior to
the change.
He argued that all the criticism of
the readjustment of the Chicago & Al-
ton's finances had been due to the un-
usual method pursued and said that if
the ordinary methods had been follow-
ed. no attention would have been at-
tracted to the transaction. •

Northern Pacific and the Great North-

the distance from the Uniqn Pacific
lines to the Southern Pactfie linos
is fully a thoousand miles while there
are many other railroads in the inter-

an argument to show that the Union

The witness objected to answering
the question and Prosecuting Attorney
Rhotan made objection to the question
on the ground that it was not relevant
to the present case and immaterial, but
he. however, withdrew the objection.
'The witness was told by Judge Lea
that he could not be compelled to give
incriminating evidence, but that where
other persons were concerned he must
answer the question
The prosecuting attorney also stated
to the court that if the witness would
tell the whole truth in reference to the
capitol building, the beer iaspection,
the railroad bill, the Argent 1 Mil and
other bills which had been corruptly
handled he would, with the cohsent of
the court, be willing to promise such
immunity as might be consistent with
justice, but that he desired that Sena-

such conditions as woud render him
liable in the event the witness should
not tell the truth. He stated that if
he would tell the truth it would throw
