gasoline or Diesel engines; such
mufflers to be approved by the
Oil and Gas Inspector and Min-
ing Inspector prior to their use.
"SECTION 14 — STORAGE
TANKS AND SEPARATORS: It
shall be unlawful and an of-
fense for any person to use,
construct or operate in connec-
tion with my producing well
within the City limits of Rusk,
Texas any storage tanks except
to the extent of two steel tanks
not exceeding 500 barrels capa-
city each and so constructed
and maintained as to be vapor
tight with connecting overflow,
and each surrounded separately
with an earthen firewall at such
distance and at such height as
will, under any circumstances,
hold and retain at least IVj
times the maximum capacity of
each tank. Separators shall be
of high test of the minimum of
6,000 pounds and shall be
equipped with both a regula-
tion pressure relief safety valve
and a bursting head.
SECTION 15 — FENCE: The
owners of each well shall, upon
completion, enclose said well,
together with all surface facili-
ties and storage tanks, with a
heavy steel fence of cyclone
type, a minimum of six (6) feet
high with all gates to be kept
•locked except when the per-
mittee or his employees are in
actuality within the enclosure.
SECTION 16 —VENTING AND
FLARING OF GAS: No person
engaged in drilling or operat-
ing any well shall permit gas
to escape or be vented in the
air unless said gas be flared
and burned. All gas flared or
burned from a torch, pipe, or
"any other burning device, with-
in the city limits of Rusk must
be done in such manner so as
not to constitute a fire hazard
to any property; and the loca-
tion of the torch, pipe or any
,othcr burning device, the con-
struction thereof, the mainten-
ance thereof, the operation
thereof, shall at all times be in
full compliance with such regu-
lations as may, from time to
time, be issued by the Oil and
Gas Inspector of the City of
Rusk.
SECTION 17- ABANDON-
MENT AND PLUGGING: (a)
Whenever any well is abandon-
ed, it shall be the obligation of
the permittee and the operator
of the well to set a 200 foot
cement plug in the bottom of
the surface casing with the bot-
tom of the plug 100 feet below
the surface casing section, and
the top of the plug 100 feet
above the surface casing sec-
tion; and to set a fifty (50) foot
cement plug in the top of the
surface casing. No surface or
conductor string of casing may
be pulled or removed from a
well. During initial abandon-
ment operations, it will be the
obligation of the permittee and
the operator of the well to
flood the well with mud-laden
fluid weighing not less than ten
(10) pounds per gallon, and the
well will be kept filled to the
top with said mud-laden fluid
at all times; mud-laden fluid of
the above specifications will be
left in the well bore below and
between cement plugs. Any ad-
ditional provisions or precau-
tionary measures prescribed by
the State of Texas or the Rail-
road Commission of the State
of Texas in connection with the
abandonment and plugging of
a well shall be complied with
by the permittee.
(b) Whenever any mine is
abandoned, it shall be the ob-
ligation of the permittee and
the operator of the mine to fill
the same back to the regular
contour of the land as it exist-
ed prior to such mining opera-
tion.
SECTION 18 — DISPOSAL OF
SALT WATER: Permittee shall
make adequate provisions for
the disposal of all salt water or
other impurities which he may
bring to the surface, and such
disposal to be made in such
manner as to not contaminate
the water supply, present or
prospective, or to injure sur-
face vegetation.
SECTION 19 —VIOLATION OF
LAWS OR REGULATIONS:
Any violation of the laws of the
State of Texas or any rules,
regulations, or requirements of
any State or Federal regulatory
body having jurisdiction in ref-
erence to drilling, completing,
equipping, operating producing,
maintaining, or abandoning m
oil or gas well or related ap-
purtenances, equipment or fa-
cilities, or in reference to fire
walls, fire protection, blow-out
protection, safety protection, or
convenience of persons or prop-
erty, shall also be a violation
of this ordinance and shall be
punishable in accordance with
the provisions hereof.
SECTION 20—AUTHORITY TO
PROHIBIT DRILLING OR MIN-
ING ON PARTICULAR LOCA-
TION: The City Council of the
City of Rusk shall have the
power, and reserves the author-
ity, to refuse any application
for a permit to drill, excavate,
and operate any well or mine
at any particular location with-
in any drilling or excavating
block where, by reason of such
particular location, the charact-
er and value of the permanent
improvements already erected
on or approximately adjacent
to the particular location in
question, and the use to which
the land and surroundings are
adapted for school, college, uni-
versity, hospital, or civic pur-
poses, or for health reasons, or
for safety reasons, or any of
them, the drilling, excavating,
or operation of such well or
mine on such particular loca-
tion migh# be injurious or a dis-
advantage to the City, or to its
inhabitants as a whole, or to a
substantial number of its in-
habitants or visitors as a group.
SECTION 21—NECESSITY OF
CONTRACT WITH SURFACE
OWNER: Neither this Ordin-
ance, nor any permit issued
hereunder, shall be interpreted
to grant any right or license to
the permittee to enter upon,
use, or occupy in any respect
to the drilling, excavating, or
operalion of any well or mine,
any surface land except by the
written contract of the surface
owner; nor shall it limit or pre-
vent the free right of any own-
er to contract for the amount
of damages, rights, or privileg-
es with respect to his own land
and property.
SECTION 22: —(1) All opera-
tions hereunder shall be con-
ducted in such manner as to
assure that there will be no in-
terference with or pollution of
any of the sands or strata from
which the water supply of the
City of Rusk or of any individ-
ual or corporation in the City
of Rusk Is produced.
(2) The City Oil and Gas In-
spector and the Mining Inspec-
tor of the City of Rusk or his
designated representatives shall
have the right to inspect all
drilling, digging, or excavating
operations to which this Ordin-
ance may be applicable as fre-
quently arid to such extent as
may be necessary to insure full
compliance with the terms of
this Ordinance.
SECTION 23: Any and all Ord-
inances of the City of Rusk
which are in conflict with any
of the terms of this Ordinance,
are to the extent of such con-
flict, hereby repealed.
SECTION 24: If any section,
sub-section, paragraph, sent-
ence, clause, phrase or word
contained in this Ordinance
shall be held unconstitutional
or invalid by the Court, the in-
validity of such stricken por-
tion shall not be construed to
affect any other part of the
Ordinance. It is the declared
Legislative intent of the City
Council that the Ordinance
would have been passed with-
out the unconstitutional portion
thereof.
SECTION 25: It shall be unlaw-
ful and an offense for an£ per-
son to violate or neglect to com-
ply with any provision hereof
irrespective of whether or not
the verbage of each section
hereof contains the specific
language that such violation or
neglect is unlawful and is an
offense. Any person who shall
violate any of the provisions of
this Ordinance, or any of the
provisions of a drilling or ex-
cavating and operating permit
issued pursuant to this Ordin-
ance, or any condition of the
bond filed*by the permittee
pursuant to this Ordinance, or
who shall neglect to comply
with the terms hereof, shall be
deemed guilty of a misdea-
meanor and shall, on convic-
tion thereof, be fined in any
sum not less than five ($5.00)
dollars nor more than two hun-
dred ($200.00) dollars; and the
violation of each separate pro-
vision of this Ordinance, and of
said permit, and of said bond,
shall be considered a separte
offense, and each day's viola-
tion of each separate provision
thereof shall be considered a
separate offense. In addition to
the foregoing penalties, it is
further provided that the City
Council of the City of Rusk at
any regular or special session
thereof, may, provided ten (10)
days notice has been given to
the permittee that revocation is
to be considered at such meet-
ing, revoke or suspend any per-
mit issued under this Ordinance
and under which drilling or ex-
cavation or producing opera-
tions are being conducted in the
event the permittee thereof has
violated any provision of said
permit, said bond or this Ord-
inance. In the event the permit
be revoked, the permittee may
make application to the City
Council of the City of Rusk for
a re-issuance of such permit,
and the action of the City Coun-
cil thereon shall be final.
SECTION 26: This Ordinance
shall be in effect from and af-
ter its final passage and publi-
cation in accordance with the
provisions of the Charter of the
City of Rus* anil the statutes of
Texas governing same.
PASSED AND APPROVED, this
12th day of June, A.D. 1962.

We at South Texas Producers Association, and Big State Creamery, and
everyone connected with the Dairy Industry, would like to take this oppor-
tunity to thank our many friends for their help in making our June Dairy
Day such a success.
