as independent executory and testamentary trustee
and as agent and attorney in fact for Mrs. Maggie
and consideration therein expressed,
BEFORE ME, the undersigned authority on this day personally appeared James P. Hart,
and R. G. Mueller, known to me, to be the persons whose names are subscribed to the fore-
going instrument, and each acknowledged to me that he executed the s ame for the purposes
and testamentary trustee of the ests e of W. S Drake, deceased, and as agent and attorney
in fact from Mrs. Maggie Drake, and declared that she had willingly signed the same for the
WHEREAS, all the sums due said Company for and on account of said assessment and said
contract have been paid in full,
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS:
BEFORE ME, the undersigned authority on this day personally appeared Margaret Drake
Thomson, wife of R.M. Thomson, Jr., and having been examined by me privily and apart from
her husband and having the same fully explained to her, she, the said Mar aret Drake
Thomson, acknowledged such instrument to be her act and deed, as independent executrix
WHEREAS, by ordinance passed on the 18th day of June, 1931, the City of Austin, Texas,
levied an assessment payable to Southwest Bitulithic Company against premises fronting
110 feet on the west side of West A venue Street in said City and County, and described
as north 110 feet of lots 1 and 2, of Assman’s re-subdivision of Block 6 of Smyth’s
subdivision of part of Outlot 75, Division "D" the said assessment being in the sum of
$325.05, and being also against the owners of said premises, and,
WHEREAS W. F.Hankey owners of said premises executed a written contract granting a
lien upon said premises to secure the amount of the said assessment for the cost of im-
proving the abose named street, payable to Southwest Bitulithic Company, which said con-
tract is recorded in Volume 468 Page 490 of the Mechanic’s Lien-Records of Travis
