stand and stated that both Mr.
and Mrs. Mullins came to his
service station at 1901 South
Broadway on the morning of No-
vember 16. He said that Mrs.
Mullins was driving the Chevro-
let and that her husband was
driving the pickup. He said that
they observed not to be hostile
toward each other at the time.
George Reese, local highway
patrolman took the stand and told
of going with Mrs. Mullins in
earch of gun shells that her hus-
band had fired in practice short-
ly before the robbery. He stated
that he found 16 fired shell cas-
ings and two lead bullets about
2% miles southwest of Van on
Farm Road 16. He said he placed
the casings in an envelope and
turned them over to the county
attorney. He later identified the
casings and lead bullets which
were entered as state exhibits.
Captain Guy Smith of Tyler, of
the highway patrol, told of go-
ing to Mrs. Mullins home on Lof-
tin Street in Tyler the afternoon
of November 16. After question-
ing Mrs. Mullins for 20 minutes
he instructed Highway Patrolman

Irby Mills, cashier of the First
National Bank of Canton, testified
that the money found was turned
over to him and that he counted
the money in the presence of Cap-
tain Smith. After counting the
money, it vzas locked in the Can-
ton bank vault for safe keeping.
Sheriff Forest Sides and Dep-
uty Elmer Pool both testified
that they had possession of the
money while the Grand Jury met
to return indictments and that
the money was returned to the!
local bank in the same condition
as it was when they took it out.
Defense attorneys L. F. Sanders
and C. L. Stanford of Canton of-
fered a motion which Judge Daw-
son overruled. The motion asked
for an instructed verdict on the
grounds that Mrs. Mullins was
not a participant in the robbery.
The case went to the jury at
5:07 p. m. and returned at 6:45
o’clock. Mrs. Mullins sobbed aloud
as the verdict was read.
