It is contemplated by the parties hereto that Contractor will, or may assign said note
and lien securing the same to Home Owners’ Loan Corporation ,which Corporation will then
and there succeed to all rights, liens, equities, estates and privileges owned and held
by the contractor, and should said note and lien be assigned to said Corporation, parties
hereto agree to comply with pertinent rules and regulations of said Corporation and execute
or cause to be executed, all instruments required by said Corporation •
Said Owners hereby give,grant and convey to said Contractor, his heirs and assigns
In consideration of the construction of said improvements and furnishing the labor and
material therefor,Owners promise and agree to pay Contractor, his heirs and assigns,
the sum of $336 • 00 in accordance with the terms of that certain promissory note of Owners,
improvements, to-wit:
Make certain repairs and paint exterior of house; in accordance with the plans and
specifications agreedupon and signed in duplicate by the parties for identification,and
which are here referred to and made a part hereof.
The land and premises upon which said improvememts are to be erected is situated at
1013 Spenee Street, in the city of Austin, Travis County,Texas,and more particularly
described as follows: Lot No. Two (2) in Block No. One(1) of Quick Addition, a subdivision
of a part of Outlot No, Forty—f our (44) in Division "o" in the City of Aust in,Travis
County, Texas ,
an express mechanic and materialmen’s lien as provided by the Constitution and laws of
the State of Texas upon the hereinbefore described property, and all improvements there
on and that may hereafter be placed thereon, to secure the payment in full of the above
mentioned indebtedness, including principal and interest, and urther to secure the per-
formance of each and every covenant herein set out ,
Conractor_ agrees to permit the Owners, their represesntatives, and the representatives
of the Home Owners Loan Corporation, access at all times to the work for the purpose of
inspection or re-examination and to provide proper facilities for such inspection and re-
the foregoing instrument, and having been exam its d by me privily and apart from her
husband, and having the same fully explained to her, she, the said Alma Pinckney,acknowl
edged such instrument to deher act and deed,and declared that she had willingly signed
the same for the purposes and consideration therein expressed,and that she did not wish
to retract it.
