NOTICE is hereby given that it is the intention of the City Coun-
cil of the City of Elgin, Texas to issue certificates of obligation of
the City in one or more series for the purpose of providing funds
to pay contractual obligations incurred or to be incurred for im-
provements, renovations, replacements, relocations and exten-
sions to the City’s water and sewer system, including construction
of facilities and acquisition of land and equipment in connection
therewith, and professional services, including legal, fiscal, en-
gineering and design fees, and the costs of issuing the certificates
of obligation. The City Council tentatively proposes to authorize
the issuance of the certificates of obligation at its regular meeting
place in the City Hall Annex, 310 North Main Street, Elgin, Texas
to commence at 7:00 p.m., on the 11th day of October, 2016. The
maximum amount of certificates of obligation that may be au-
thorized for the above listed purposes is $3,000,000. The City
Council presently proposes to provide for payment of the certifi-
cates of obligation by a pledge of ad valorem taxes upon all tax-
able property within the City within the limits allowed by law.

limited pledge of the City’s surplus water and sewer system rev-

Interested persons are invited to submit written comments on the application
within thirty days after the last date of publication of this notice in a local
newspaper. All written comments, objections or requests for public hearing

The accepted bond for Permit No. 48C is covered in the form of a blanket
collateral bond in the amount of $1,100,000,000. The applicant does not seek
adjustment to the approved bond as a result of this application; however, an
eligible bond reduction amount may be determined.

Pursuant to Section 134.128 - .134 of the Texas Surface Coal Mining and
Reclamation Act, TEX. NAT RES. CODE ANN. (Vernon 2016) and Section
12.312 - .313 of the Coal Mining Regulations, Tex. R.R. Comm’n, 16 TEX.
ADMIN. CODE Ch. 12 (West Group 2013), Luminant Mining Company
LLC, 1601 Bryan Street, Dallas, Texas 75201, has submitted its application
to the Railroad Commission of Texas for Phases I (516.9 acres) release of
reclamation performance bond obligations for a portion of its Three Oaks
Mine, Permit No. 48C. The proposed release area is depicted on the
attached map. The Three Oaks Mine permit area is located in Lee and
Bastrop Counties, northeast of Elgin, Texas. Permit No. 48C was issued
by the Railroad Commission of Texas (RCT) on July 15, 2013, and the most
recent bond for the permit was approved in the form of a blanket collateral
bond on June 17, 2014.
The applicant requests a release of Phase I, (60%) reclamation obligations
516.9 acres. Phase I requires the completion of backfilling, regrading and
drainage control. The areas proposed for release are shown on the map
printed with this public notice. Mining operations were conducted on the
516.9 acres in 2005-2010. Final grading was accomplished on this area
in 2006-2012, and in 2006-2012 vegetation was planted. Vegetation was
declared successfully established and accepted by the Commission into the five year
extended responsibility period on May 13, 2015. Six (6) permanent stream diversions,
nine (9) permanent impoundments, two (2) inlets, and one (1) spillway are located
within the boundaries of this release area.
