"This is state law," Phillips said.
"What is the penalty for non-
compliance?" Broaddus asked. "I
don't think there is one. I don't
think money is in the budget for
this."
Commissioner Mickey Brooks
said it was his understanding that if
the office did not prove itself, it
would be abolished.
It is easier to refuse to create new
positions than it is to abolish them
once they are created, Broaddus said,
adding that over $100,000 in new
taxes will be necessary to continue
the office.
"This is another example of a
state mandate with no funds,"
Broaddus said. ___________________

Funding of the probate court
investigation office for the
remainder of fiscal year 1994 has
been approved by a three-to-two
split vote of Brazoria County
Commissioners Court, with
Commissioners Jim Clawson and
Ronnie Broaddus dissenting.
Cost for the department,
including the salaries of two
investigators and a secretary is
listed at $107,725.
Clawson told other court
members he agreed to hiring one
investigator, to meet the minimum
requirements of the new state law,
but could not go along with two
investigators and a secretary.
County Judge Jim Phillips said
the court approved the hiring
earlier, that the personnel are
already working, and that the matter
on the agenda was simply funding
