R. Rundell, of Travis County, Texas, party of the first part, and William L. Lowitz and wife
Elizabeth B. Lowitz, both of Travis County, Texas, parties of the second part, WITNESSETH;
2. That the said party of the first part, for the consideration hereinafter mention-
ed, hereby agrees and binds himself well and truly to construct, erect, finish, complete
and deliver in a true, perfect and workmanlike manner, a one-story rock vaer residence,
according to plans and specifications agreed upon by and between the parties hereto, signed
by the parties hereto for identification, and made a part of this contract for the said
parties of the second part, upon all that certain tract or parcel of land situated in Travis
wife of Elisha N. Prewitt, known to me to be the person whose name is subscribed to the fore-
going instrument, and having been examined by me privily and apart from her husband, and
having the same fully explained to her, she, the said Lizzie E. Prewitt, acknowledged such
instrument to be her act and deed, and declared that she had willingly signed the same for
the purposes and consideration therein expressed, and that she did not wish to retract it.
In Block No. 5, of the W. A. Harper Subdivision of a part of Outlots 7 and 8, in Division
"C" in the City of Austin, Texas, according to the map or plat of said addition recorded in
Book 3, page 89 of the Plat Records of Travis County, Texas, and being the same property
conveyed by The Fidelity Trust Company, to "illiam L. Lowitz and wife, Elizabeth B. Lowitz,
by deed dated the 1th day of September, A. D. 1938, recorded in Book No. 594, page 508, of
the Deed Records of Travis County, Texas, to which deed and the record thereof reference
is here made....... and to furnish and provide first class work and materials for all parts
thereof that may be necessary for the full completion of the said improvements, according
to the said plans and specifications; that the said party of the first part hereby agrees
