3. Parties of the second part here state that they own in fee simple free and clear
of all liens and incumbrances, recorded or unrecorded, except as herein provided,the property
hereinabove described.
4. It is especially agreed that the entering by parties of the second part into pos-
session of said improvements, or the acknowledgement by him of completion of this contract
as well as any other sufficient proof, shall be conclusive evidence that all duties aid ob-
ligations of party of the first part have been fully and completely performed.
5. This contract is executed and delivered before any labor or material for the erection
and construction of said improvements has been furnished.

consideration therein expressed. And also before me on this day prsnally appeared
Juanita West, wife of the said John R. West, known to me to be the person whose name is su
scribed to the foregoing instrument and having been examined by me privily and apart from
her husband and having the same fully explained to her, she, the said Juanita West, acknow
1 edged such instrument to be her act and deed and declared that she had willingly signed
the same for the purposes and consideration therein expressed, and that she did not wish
to retract it.

same become delinquent, or fail to keep the improvements insured as aforesaid, or fail to

holder of said note or notes, the note or notes described hereinabove principal and interest
then accrued shall at once become due and payable, and suit may be immediately commenced
