of erecting a residence on property owned by the said R. D. Moore, and wife, Nellie Moore,
in the City of Austin, Travis County, Texas, more particularly described as follows:
Lot No. Three (3) in Block No. Four (4) in the Bergman Valley View Addition, a resub-
division of Washington Park Addition, in Outlot No. 66, Division C, in said City of Austin,

The said R.D. Moore and wife, Nellie Moore, hereby agree bind and obligate themselves
to pay to said Capital City Lumber Company, Inc. at Austin, Texas, the sum of Five Hundred
Eighty ($580) Dollars, for the furnishing of the materials set fa? th in said above referred
to itemized statement, all of such consideration to be paid in accordance with the
tems of one certain me terialman’s , promissory note this day made, executed and delivered .
by the said R. D. Moore and wife, Nellie Moore, to Capital Ci ty Lumber Company, Inc.,
said note being dated at Austin, Texas, April 13, 1939 , in the principalsum of Five Hundred

thereof reference is here made for all pertinent purposes, and being the same property con-
veyed by Doyle Moore and wife, Helen Moore to R.D. Moore by deed dated September 21, 1936,
and recorded in Volume 555, page 125, of the Deed Records of Travis County, Texas; and
WHEREAS, the said R. D. Moore, and wife, Nellie Moore arein a position to and will
erect and build a residence on said above described premises at their own expense and with-
out the necessity of placing any character of lien on said property, but are unable to
purchase aid pay for at this time the doors, windows, frames, roofing and small hardware,
nails and similar materials for the erection and construction of said residence, and have
requested Capital City Lumber Company, Inc. to furnish the materials necessary for the erec-
tion and construction of said improvements according to an itemized statement of all of such
materials heretofore agreed upon between the said R. D. Moore and wife, Nellie Moore, and
Capital City Lumber Company, Inc., a copy of which said statement has been signed by the
parties hereto for the purpose of identification, and such statement of the materials to
be furnished is made a part hereof as though the same were here set out word for word.
NOW, THEREFORE, in consideration of the fact that the said R. D. Moore and wife,
Nellie Moore, have covenanted and agreed with said Capital City Lumber Company, Inc., a
corporation duly incorporated, with its office and principal place of business in Austin,
Texas, and by these presents do hereby covenant and agree with said Capital City Lumber
Company, Inc. that they will erect, construct, complete and finish in a good and substan-
tial workmanlike manner, within a reasonable time from date, such improvements on the
above described property according to certain plans and specificatiohs agreed upon by
parties hereto, performing or causing to be performed all of the labor in the erection of
such improvements and paying all other expenses incident to same, and the said R. D. Moore
and wife, Nellie Moore, agree to bear any loss or damage that may occur to said improve-
ments from any cause whatever during the course of construction until the same is com-
pleted.
