Beginning at the South east corner of Lot No. 54; thence Northerly with the east line of
lot No. 54 for 102 feet to an iron stake; thence North 60 degrees VI. to a point in theest
line of said Lot No. 54; thence with the West line of said Lot No. 54 to the South
west corner of said lot; and thence S. 60 degrees E. 47.96 feet to the place of beginning,
together with all improvements thereon or to be erected thereon; and being the same real
property bought by W. H. Sproull and wife, Mrs. Beatrice M. Sproull from Mrs. Margaret D.
Okie, et al, on April 5, 1939, as per warranty deed recorded in Book No. x, page x, of
the Deed Records of Travis County, Texas, to all of which reference is here made for all
or pf collected by legal proceedings of any kind an additional Ten (10%) per cent is to
be added and paid as attorneys fees for collection, being signed by W. H. Sproull and
wife, Nrs. Beatrice M. Sproull and payable at Austin, Texas, to the order of H. W. Leveret
secured in its paymert by the Mechanic’s lien and the Materialman’s lien herein retained

said W. H. Sproull and wife, Mrs. Beatrice M. Sproull, parties of the second part, to
furnish them at Austin, Texas, at their fair cash value the labor and materials necessary
to be used in constructing the following improvements upon the homestead of the said part'
of the second part, viz.:
3rd. And we, the said .. H. Sproull and wife, Mrs. Beatrice M.Sproull, the owners of said
real property, do hereby give and grant to the said H. W. Leverett, his heirs or assigns,
v 2nd. That the said W. E. Sproull and wife, Mrs. Beatrice M. Sproull, parties of the second
part, in consideration of said labor and materials being so furnished agree to pay at
Austin, Texas, the reasonable cash value of the labor and materials so used in constructing
said improvements amounting to the sum of Nineteen Hundred ($1900.00) Dollars according to
the terms and conditions of a certain Mechanic’s Lien and Mat erialman’s lien note in
th© sum of Nineteen Hundred ($1900.00) Dollars dated May 2nd, 1939, due on monthly payments
of Twenty five ($25.00) Dollars or more per month commencing on the 1st day of July, A. D.
1939, and continuing thereafter due in monthly payments of Twenty five ($25.00) dollars or
more per month on the 1st day of each and every month thereafter until the principal sum
of Nineteen Hundred ($1900.00) Dollars together with all interest thereon has been paid in
full, providing that failure to pay any one monthly payment of Twenty five ($25.00)
Dollars when due or failure to pay the insurance or taxes on said property as herein
provided, at the option of the holder of said note to mature said note, bearing Seven (7%)
per cent interest thereon from date and payable semi-annually after date and said monthly
payments semi-annually after date to be first applied to the interest due on said note and
the balance then to be applied to the principal of said note, and providing that if

interest be not paid When due to become as principal and bear the same rate of interest, "
providing that if said note be placed in the hands of an attorney for collection after maturit

heretofore agreed upon and made a part hereof for all necessary purposes.
Said improvements are to be erected upon the following tract of land in the County of Travis
in the City of Austin, and in the State of Texas, viz.:
The .South 102 feet of Lot No. 54, in Okie Heights Addition in the City of Austin, in
Travis County, Texas, according to the map or plat of said Addition of record in Plat
Pook No. 3, page 255, of the Plat Records of Travis County, Texas, to all of which
reference is here made for all purposes, and said tract being further described as
follows:
