provements as the same accrue, and to have the same completed, according to the said plans
and specifications, and ready for occupancy on or before Sixty (60) working days, from this
date, free from any and all claims on the part of any and all persons for materials and
labor used in and performed on the said improvements for the sum of Thirty-one Hundred
($3100.00) Dollars to be paid by the said parties of the second part to the said party of
the first part as hereinafter provided.

L That the said party of the first part, for the consideration hereinafter mentioned
after maturity, or if collected by legal proceedings of any kind, for an additional ten

2. That the said parties of the second part, in consideration of the foregoing agree-
ment and understanding on the part of the said party of the first part, hereby agree, bind
themselves and promise to pay to the said party of the first part, for the fulfil Imant of
his said agreement and undertaking at Austin, Texas, the said sum of Thirty-One Hundred
($3100.00) Dollars, on and in accordance with the terms of their one certain promissory not
bearing even date herewith, payable on or before Sixty (60) days from date and said note
bearing interest from maturity until paid at the rate of 6 per cent per annum, and the
BEGINNING at an iron stake at the northwest corner of Lot 5, Block 5 of the Monroe
Heights Addition, subdivision to the City of Austin, and being a portion of the Isaac Deck-
er League, according to a map or plat records in Plat Book 3, page 219; Thence with the
north line of lots 5 and 6, S. 59 deg. 46’ E. at 70 feet passing the northeast corner of
Lot 5, and the northwest corner of Lot 6, in all 111.85 feet to an iron stake for a corner;
Thence S. 30 deg. 02’ W, 45 feet to an iron stake for a corner; Thence N. 62 deg 22* W. at
41.85 feet, crossing the west line of Lot 6, and the east line of Lot 5, in all 111.58 feet
to an iron stake in the west line of Lot 5, for a corner; Thence with the west line of Lot
5, N. 29 deg. 43’ E. 50 feet to the place of the beginning, containing 5,308 square feet of
land, as surveyed by the Metcalfe Engineering Company on August 23, 1938.
and to furnish and provide first class work and materials for all parts thereof that may be
necessary for the full completion of said improvements, according to the said plans and
specifications; that the said party of the first part agrees to be responsible for any
damage that may happen to the said improvements in the course of erection from fire, or from
any other cause whatsoever, until the same have been completed, according to the said plans
and specifications, by the said party of the first- part, turned over to and accepted by
the said parties of the second part, that the said party of the first part hereby agrees
and binds himself to pay for all materials and labor used in and performed on the said im-

of land lying and being situated in Travis County, Texas, and described as follows, towit:
Being a portion of Lots Nos. Five (5) and Six (6), Block No. Five (5) of the Monroe
Heights Addition in the City of Austin, Travis County, Texas, according to the map or plat
of said addition of record in Book 3, page 219 of the Plat Records of Travis County, Texas,
to which reference here is made and being more fully described by metes and bounds as fol-
