binds himself to construct, erect, and complete for Owners a three-car rock and frame garage
with four-room apartment over, to be used in connection with the main residence and other
or other causes, such policy or policies of insurance to contain loss clause payable to
Contractor and Owners as their respective interests may appear.
Owners jointly and severally (it being understood that this contract is made for the
use and benefit and for the preservation of the separate estate of Rovena W. Phares), in
consideration of the foregoing agreement and undertaking on the part of Contractor, hereby
agree, bind themselves, and promise to pay to the order of Contractor at Austin, Texas, the
sum of Two Thousand, Nine Hundred Twenty ($2,920.00) Dollars, such consideration to be paid
the same property conveyed by warranty deed of W. 0. Harper, et al, dated May 9, 1935, to
at the rate of seven per cent (7%) per annum, said note being due and payable in installment?
of Twenty ($20.00) Dollars, or more, on principal, plus interest accrued to the date of such
THIS CONTRACT made and entered into this day by and between Rovena W, Phares, joined
herein by her husband, L. G. Phares, of Travis County, Texas, hereinafter called Owners,
and w. G, Bailey, of Travis County, Texas, hereinafter called Contractor, WITNESSETH:
That Contractor, at the request of Owners, and for the consideration hereinafter agreed
by reason of the erection of such improvements, save and except the lien hereinfor provided
in the sum of Two Thousand, two hundred and seventy ($2,270.00) Dollars by the 15th day of
January, 1939, or within a reasonable time thereafter. Contractor shall, at his own expense
keep the improvements in the course of construction insured against loss or damage by fire,
