All those certain lots, tracts or parcels of land, lying and situated in the County of

follows: All of Lot No. Eight (8), and the West twenty-three (23) feet of Lot No. Seven (7)
in Block No. Sixty-five (65), City of Austin, Travis County, Texas, according to the plat of
Volume 550, pages 465, et seq., Deed Records of Travis County, Texas,to which said deed and
to the record thereof reference is here made for a more particular description,--together with
all improvements thereon situated, and together with all improvements which may be placed
thereon, so long as the notes herein secured, or any part of them, remain unpaid.
TO HAVE AND TO HOLD all and singular, the above describedproperty, together with all rights
on or before May 1, 1939, each
on December 22, 1938; $3,000.00 on January 22, 1939; and $2,600.00 on February 22, 1939; each
installment payment bearing interest from due date until paid at the rate of seven per cent
(7%) per annum; and Note No. 2 for the sum of Ten Thousand ($10,000.00) Dollars, bearing
interest from March 1, 1939, until paid at the rate of seven per cent (7%) per annum, interest
due and payable May 1, 1939, and semi-annually thereafter, and providing that past due
interest shall bear the same rate of interest, the principal of said note being due and
end appurtenances thereto in anywise belonging, unto the said 0. D. Farquhar, Trustee, and to
his successor or successors in trust, with covenants of general warranty, save and except as
against unpaid balance of valid and subsisting vendor’s and contract lien on said property
retained in and described in the foregoing mentioned deed from William Bohn, et al, to me.
This deed is made, executed and delivered by me, however, in trust and for the purpose of
better securing Kuntz-Sternenberg Lumber Company, a corporation duly incorporated, being
organized and existing under the laws of the State of Texas, and having its principal place
of business in Austin, Travis County, Texas, and which is hereinafter called Party of the
Third Part, in the payment by me to it of my certain valid obligation to it in the sum of
Eighteen Thousand, Six Hundred ($18,600.00) Dollars, this day loaned by it to me and used
by me for the purpose of placing additional improvements on the above described property, all
as evidenced by my two certain negotiable promissory notes, bearing even date herewith,
Note No. 1 for the sum of $8,600.00, and due and payable in installments as follows: $3,000.
