known as the South 50 x 70 feet of Lot 16, in Block 132, of the Llano Improvement and
Furenoe Company’s Addition to the town of Llano, Llano County, Texas, and I further certify
that I have no intention of ever occupying the property herein conveyed as my homestead.
And it is further specially agreed by the parties hereunto that in any deed or deeds given
by any Trustee or substitute duly appointed hereunder, any and all statements offsets or
other recitals therein made as to the non-payment of the money secured, or as to the request
to sell, the time, place, terms of sale and property to be sold having been duly published,
or as to any other act or thing having been duly done by any Trustee, or substitute, shall
be taken by any and all courts of law and equity as prima facie evidence that the said stat J
ments or recitals do state facts, and are without further question to be accepted. And Otis
substitute, or hit successor in this trust may lawfully do in the premises by virtue hereof.
Erasures and interlineations made and approved before signing.
It is specially agreed that when, as and if any accelerated maturity of any item secured by
this instrument may be declared due under any term of this or any other paper evidencing
writing, substitute Trustee, who shall thereupon succeed to all the estate, rights, powers
trusts hereinbefore granted to and vested in said Trustee.
And I hereby designate as my homestead under the laws of the State of Texas, the property
receive the proceeds of said sale and apply the same as follows: First, to the payment of
all necessary costs and expenses incident to the execution of said trust, including a fee
to the Trustee of x per cent to be estimated upon the amount realized at said sale. Secona
to the payment,ratably of said note, then unpaid principal and accrued interest (it being
understood that when default shall be made in the payment of any of said note, or any
installment of interest on said note, or failure to pay any State, County or City taxes asses,,
upon said property, after the same by law becomes delinquent, all of the principal of all
notes secured hereby together with accrued interest thereon to the date of the exercise of
the option shall become at once due and payable, at the option of the holder or holders
