There has not been a prisoner in
the county jail of King County for
three years and the locks on the doois
have become rusty. This is the report
made by the Sheriff of that county,
and if anybody knows the facts re-
garding the situation there the Sheriff
of that county ought to know.
This certainly is complimentary to
the citizenship of King County, away
up in the Panhandle of Texas, in a
country where, according to the popu-
lar idea, every man is a walking ar-
senal and every citizen a man-killer.
But the popular idea is a bad idea.
It is not in accord with the facts.
The Panhandle section of Texas is
not peopled exclusively with cut-
throats and robbers, as many persons
imagine, but in that section will be
found schoolhouses and churches and
Sunday schools and all the other fea-
tures of religious and moral civ iliza-
tion, and the people are as hospitable,
as honest, as ttie-heaed as any peo-
ple to be found in any section of the
United Slates or of the vorld, as for

human system, still such liquors con-
tain substances which are far more
harmful to the health than liquors
manufactured by the use of pure malt
and hops, and, as stated above, we are
not willing to give to the law a con-
struction, the effect of which would be
to bar the use of liquor in the manu-
facture of which is used the less harm-
ful ingredients without the payment
of a heavy tax, and at the same time
permit the liquor to be freely sold
without any tax which contains the
more harmful ingredients.
The phrase “malt liquor” should be
given its ordinary and common sense
meaning, which would, in the opinion
of this Department, include all of the
substances and imitations as well as
the genuine malt liquors.
You are, therefore, advised that all
persons, corporations, firms, or asso-
ciations of persons, engaged in selling
non-intoxicating liquors manufactured
from the use of pure malt, or any
other recognized substitute of malt,
would be liable to the tax levied in
the act of the Thirty-First Legisla-
ture cited above.
