Hebbronville were visiting here at
the weekend in the home of Mrs.

Jack Davis injured
In football Practice
Jack Davis, son of Mr. and Mrs.
C. H. Davis of Mercedes, is in the
McCalip-Ivy Hospital at Weslaco,
following an injury received Tues-
day, a week ago, in scrimmage
football. Not realizing that he was
hurt to any extent, Davis played
in the football game at Browns-
ville last Thursday night.
Monday, Davis was takn to the
hospital at Weslaco by his parents
for observation, when hospital doc-
tors discovered that the sixth
vertebra had been broken and a
smaller bone had also been broken,
broken.

Grammar School Parent - Teacher
Association last Saturday night at
the school cafeteria Was a huge
success and enjoyed by approxi-
mately one hundred people who
participated in the various games
of the evening. The Assiciation

Mercedes, who contributed attrac-
tive prizes.
Door prizes were awarded Mrs.
H. J. Menton, J. M. Shirk, Merce-
des, and Mrs. Fritz Grebin of Har-
lingen.

joyed a weekend visit from their
daughter, Barbara, who is a stu-
dent in the Baptist Memorial Hos-
pital at San Antonio.,

rated with blood. Last year alone,
37,500 people were killed in high-
way accidents. Another 2,000,000
were injured.
There is no way to adequately
describe the suffering of the vic-
tims and their families'. But any-
one can see that the price we are
paying for recklessness, careless-
ness, and incompetence behind the
wheel is out of all reason and must
be reduced.

ence course at Sam Houston State
Teachers College at Huntsville.

In order to be personally liable,
the parent must himself be impli-
cated in some way. The rulles
which apply here are similar to
those regulating the liability of an
employer for the negligent acts of
his employee.
Thus, although the law takes an
extremely protective attitude to-
ward minors and their contractual
liabilities, allowing them many
privileges not accorded mature
persons, no substantial distinction
is made with regard to liability for
negligence.

There is still another aspect to
this—the economic aspect. Last
year alone, despite all possible
savings and economies, the auto-
mobile casualty insurance industry
was unable to make both ends
meet. The premiums it collected
were more than $100,000,000 less
than it had to pay out because of
the steadily mounting cost of acci-
dents. Manifestly, no enterprise
can long operate on a dificit basis.
The immediate answer is higher
rates. But it is conceivable that,
should the rates go high enough,
the insurance companies would be
priced right out of the market. And
then the alternative would become
government- operated compulsory
insurance, paid for in part through
premiums and in part by taxes.
And anyone with the slightest
knowledge of givernment-in-busi-
ness knows that it. is always ac-
companied by flagrant waste and
inefficiency, by ever-expanding, pa-
tronage-staffed bureaus, and by an
insatiable appetite for more of our
tax money. Even worse, govern-
ment-in-business means less free-
dom and opportunity for our people
—and brings us closer to the
tyranny of total socialism.
There is only one answer to the
prise to many to learn that the
minor himself may be held legally
accountable. It is a well settled
principle of law in the State of
Texas that a minor, who by his
negligent acts injures another, is
liable in damages to the injured
party.
Upon proper proof being pre-
sented to the court, a judgment for
the damages inflicted by the minor
may be secured in behalf of the
injured party. In cases where a
minor is thus sued for his negli-
gent acts, it is necessary that the
judge appoint a special guardian
for the minor, known as a Guard-
ian Ad Litem. The duty of this
person is to see that the minor’s
rights are properly protected, and
that he is adequately represented
on the trial of the case.
A judgment secured in such
cases against the minor is a valid
and binding judgment which may
be satisfied by levying execution
upon any property which the minor
may own which is legally subject
- .
enough property to satisfy the
judgment.
Now, however uncertain this
means of gaining redress for in-
juries may seem, in many cases it
may prove to be the ONLY method
of collecting damages. For, when
the chips are down, your chances
of FORCING repayment from the
parents are usually very slim.
From a legal standpoint, there is
nothing in the parent-child rela-
tionship which automatically rend-
ers parents liable for the negligent
acts of their children.

Should the minor have no prop-
erty upon which execution can be
levied, and satisfaction made, then
steps should be taken to keep the
judgment alive. There are means
of keeping such judgments alive
for many years. By doing this, and
by keeping track of the minor, it
is possible to make the judgment
follow him until he eventually
does acquire property subject to
execution.
Of course, there are practical
considerations in a lawsuit against
a minor. The most frequent stumbl-
ing block is naturally the situation
of a minor having absolutely no
property to satisfy any judgment
which may be secured.
However, this lack of property
in no way affects the right of the
injured party to his judgment,
which, as mentioned above, may
