CHAPTER 160 S.B. No. 1012
1 AN ACT
2 relating to the placement of electronic monitoring devices in the
3 rooms of certain residents in assisted living facilities.
4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
5 SECTION 1. Section 247.003, Health and Safety Code, is
6 amended by amending Subsection (a) and adding Subsection (c) to
7 read as follows:
8 (a) Except as provided by Subsections [Sbacctin] (b) and
9 (c), Chapter 242 does not apply to an assisted living facility
10 licensed under this chapter.
11 (c) Except as provided by this subsection, Subchapter R,
12 Chapter 242, applies to an assisted living facility, and the
13 department shall administer that subchapter for an assisted living
14 facility in the same manner it is administered and enforced for a
15 nursing home, but shall enforce that subchapter in accordance with
16 the sanctions authorized by this chapter. Sections 242.851 and
17 242.852 do not apply to an assisted living facility or to conduct
18 within an assisted living facility.
19 SECTION 2. The Texas Board of Human Services shall adopt
20 rules necessary to administer Subsection (c), Section 247.003,
21 Health and Safety Code, as added by this Act, not later than January
22 1, 2004.
23 SECTION 3. This Act takes effect immediately if it receives
24 a vote of two-thirds of all the members elected to each house, as1
