Now, therefore, in consideration of the fact that said party of the first part has
covenanted and agreed with the said parties of the second part that he will well and truly
build the said house in a good substantial and workmanlike manner by the 1st day of March
A.D. 1940 on the said above described property, performing or causing to be performed all
of the labor in the improvement or erection of the same, and furnishing all of the material
of whatsoever kind necessary to be used in the erection of the same, and paying all ex-
penses incident to the said labor and furnishing of material, the said dwelling house and
improvements to be built of good substantial material and to be erected strictly according
to the plans and specifications, here referred to and signed by the parties for further des-
cription.

And the parties of the second part agree, bind and obligate themselves to pay to the
said party of the first part at Austin, Texas, the sum of Nineteen Hundred and no/100
Dollars as follows: $300.00 to be paid upon completion of the work the balance to be evi-
fenced by one certain promissory note of even date herewith for the sum of $1600.00 executed
bY the said parties of the second part, jointly and severally, payable to the order of the
said Walter Foust party of the first part, at Austin, Texas, bearing eight per cent interest
Per annum until paid, due six months after date, interest due and payable at maturity,
Providing for ten per cent additional thereon on amount of principal and interest then due
as attorney’s fees if placed in the hands of an attorney for collection, or in case suit is
brought on same and providing failure to pay said note or any installment of interest when
due, shall, at the option of the holder of said note, mature said note.
It is expressly agreed and understood that to secure the payment of said indebtedness
ror the sum of $1900.00 the said party of the first part retains, and shall have a valid,
xisting mechanic’s, materialman1 s, laborer’s and contractor’s lien, equity, security and
interest in and to -the above described real estate, constituting one body of land and in-
tended to be used and enjoyed in connection with the improvements contemplated in this
ontract, and the improvements to be erected thereon, and it is agreed and understood that

subrogated to all of the rights and equities of the said party of the first part, to have
