in and performed on the said improvements as the same accrue, and to have the said improve-
ments completed, according to the said plans and specifications, and ready for occupancy
on or before forty working days from this date, free from any and all claims on the
boxing garage, according to plans and specifications agreed upon by and between the parties
hereto, signed by the parties hereto for identification and made a part of this contract,
for the said parties of the second part, upon all that certain tract or parcel of land,
lying and being situated in Travis County, Texas and describedas follows, to-wit:
erection from fire, or from any other cause whatever, until the same have been completed ,
according to the said plans and specifications, by the said party of the first part,
turned over to and accepted by the said parties of the second part, that the said party
of the first part hereby agrees and binds himself to pay for all materials and labor used
both of Travis County, Texas, parties of the second part, Witnesseth:
1. That the saidparty of the first part, for the consideration hereinafter mentioned,

particulars, and to furnish and provide first class work and materials for all parts

Lot No. 10, in Northfield, a subdivision of a part of the James P. Wallace League as
shown in Plat Book 3, at page 183 of the Plat Records of Travis County, Texas, and being,
the same property conveyed by Mae Murray to Ira G. Shaw and wife, Goldie A. -.Shaw, by deed
dated the 2nd day of April, A. D. 1940, recorded in Book No. 643, pages 295 to 296 in-
clusive of the Deed Records of Travis County, Texas, to which reference is here made for

the whole of the said note, principal and interest then accrued; shall at once
part of any and all persons for materials and labor used in and performed on the said
improvements for the sum of Nineteen hundred ($1900.00) Dollars, to be paid by the said
parties of thesecond part to the said party of the first part as hereinafter provided.
2. That the said parties of the second part, in consideration of the foregoing agree-
ment and undertaking on the part of the said party of the first part, hereby agree, bind
themselves and promise to pay to the said party of thefirst part, for the fulfillment
of his said agreement and undertaking, at Austin, Travis County, Texas, the said sum of
Nineteen hundred ($1900.00) Dollars, on and in accordance with the terms of their one
certain promissory note, beaing even date herewth, payable to the order of A. F. Saunders,
at -Austin, Travis County, Texas, for thesum of Nineteen hundred ($1900.00) Dollars, and
said note bearing interest from date until paid at the rate of seven per cent per annum,
and to be included in the payment hereinafter mentioned, and the principal and interest
o said note to be .payable in installments as follows: One installment of Twenty three
and 75/100 ($23.75) Dollars to be paid on or before the 30th day of June, A. D. 1940,
and one installment of Twenty three and 75/100 ($23.75) Dollars to be paid on or before
the 30th day of each and every month thereafter, until said promissory note has been
tu-ly paid and satisfied, and the said installments to be applied first to the payment
01 interest accrued on said note at thedate such installment is paid, and the remainder
to the principal of said note, and the said note providing if the same should beplaced
in the hands of an attorney for collection after maturity, or if collected by legal
Proceedings of any kind, for an additional ten per cent on the amount to be collected
for attorney's fees, and the said note further providing that if any one of the said in-
stallments of the said note shall not be paid when due, then, at the option of the holder
