BARKMAN TRIAL.
The following proceedings were
had yesterday at the Barkman
trial at Pittsburg Texas:
The case was called at 8:50 a. m.
and the usual sparring of attor-
neys set in. The lawyers for the
defense made a motion to itrike
out the transcript prepared lly the
clerk at Boston alleging it was not
drawa according to law or the pa-
per did not certify that it contain-
ed all the “orders" of the court
but simply said it contained the
proceedings The court overruled
the objection and the lawyers for
the defense excepted.
Both sides after this spat '.an-
nounced ready for trial and the
jury was called and after the usual
number of challenges the following
named panel was selected:

Phillips.
The case promises to be quite in-
teresting and hard fought as some
of the best lawyers in the district
have been engaged on both sides.
The defense have engaged Todd
& Glass John J. King of this city
and Zachry A Heath and the state
will be represented by Prosecuting
Attorney R. D. Hart of this city
and Sheppard A Jones of Pittsburg
aided by F. M. Brooks county at-
torney of Bowie county. *
Several of our leading citizens
were summoned last night to ap-
pear at the trial today the tele-
gram asking them to come said
there was an effort made by the
defense to Impeach witness Dan
Ferguson and this evening J. ( W.
Harrlss and F. W. Mullins and sev-
eral others will go down t'o answer as
to the character of Dan Ferguson
who is regarded here as a truthful
man. From a private letter shown
us we learn that the evidence thus
far produced Is very damaging to
Barkman.

behalf ot the State. In thlievidence
It was made clear that Barkman
