Austin, Tex., Sept. 8.—The opinion
of the attorney general's department
to the effect that the anti-pass law
'does not disturb or abrogate contracts
for transportation made before said
act became effective is important to
the telegraph and-express companies.
These two classes of corporations had
contracts with the railroads to run
for several years, wherein it was pro-
। vided that the employes of the express
and telegraph companies should have
transportation, also the officers and
agents of said corporations.
The opinion of the attorney gener-
ate department will probably result
in the railroads issuing transportation
to the express and telegraph com-
panies the same as before, as set out
in the contracts.
j Railroad .Commissioner Colquitt
does not agree with this construction
by the attorney general's department,
as he criticised the Houston opinion.
. granting the express companies relief
in their suits to compel the railroads
to furnish transportation in accord-
ance with the terms of the contracts.
It is made the duty of the railroad
commission to enforce the law, but the
attorney general does the prosecuting,
hence transportation issued under the
latest ruling would hardly bring pros-
ecution on, part of the State, even
though one of the commissioners did
not believe it legal.
. What the status of the express and
railroad companies will be upon the
expiration of the present contract's is
another question. The opinion says
contracts already made cannot be ab-
rogated or interfered with, and that
it was not the intention to disturb
them. But when they expire can the
new papers provide for transportation
for the employes of express and tele-
graph companies?
, The attorney general's department
is inclined to hold that logging roads
do .not come within the provisions of
the anti-pass law, as they are private
enterprises, and that it Is not neces-
sary for telegraph and telephone com-
panies to apply to the commission for
authority to apply special rates. Opin-
ions on these subjects may be made
