Several students who have been
ill, are back in school. We are very
glud to have them back. A few art
still out on account of sickness.

a bit of entertainment for the clos-

tain when it will be.
Last Friday night, April 4, Mrs.
Fritz Boedeker, teacher of grades

with "scavenger" party. After

were served to the quests. Every-

ing publication of this Citation once
in each week for four consecutive
woeks previous to the return day
hereof, in some newspaper pub-
lished in your County, if there be
a newspaper published therein, but
if not, then in the nearest County
where a newspaper is published, to
appeur at the next regular term of
the District Court of Burleson
County, to be holden at the Court
House thereof, in Caldwell, Texas,
on the tenth Monday after the first
Monday in Marc h,A. D, 1986 the
same being the 11th day of May, A.

a petition filed in said Court on
the 24th day of October , A. D.
in a suit., numbered on the
docket of said Court No. 12,023,
wherein Tom C. Newcomb is
Plaintiff, and Janet Newcomb is
Defendant, and a brief statement
of plaintiff's cause of action, being
as follows: That plaintiff is and
has been for a period of twelve pri-
or to exhibiting the petition here-
in an actual bona fide inhabitant
of the Stal>- of Texas, and has re-
sided in said County of Burleson
fur at least six months next im-
mediately preceding the filing of
this suit; that on or al>out the 11th
day of July, 1031, in Burleson
County, Texas, plaintiff was law-
fully married to defendant; that
they continued to live together as
husband and wife until on or about
15th day of September, A. D. 1935,
when by reason of cruel and harsh
treatment and improper conduct of
defendant toward plaintiff she
abandoned pluintiff and since which
time th«y have not lived together,
and plaintiff is forced and com-
pelled to permanently abandon her
and (hut he can never live with her
again; that plaintiff was always
kind and affectionate to defendant
and always provided for her sup-
port and maintenance, but di-fen-
(iant unmindful of the duties and
obligation of her murital vows
about one year prior to the time
of said separation begun a course
id' unkind, harsh, tyrannical and
cruel treatment toward plaintiff
which continued and constantly
grew worse until the defendant fin-
ally left plaintiff and he was forc-
ed and compelled to separate from
her with the intention of never liv-
ing with her again; that defendant
often cursed and abused plaintiff
and applied to him the vilest and
most opprobious epithets without
any cause or provocation whatso-
ever on the part of this plaintiff;
that on or about the 1st day of
August, 11)34, defendant cursed and

ed away for some time; that on or
about the 1st day of December,
1034, the defendant slipped up be-
hind plaintiff and knocked him
down with a water pitcher render-
ing him unconscious; that on or
about the 26th of August, 1936, the
defendant got a gun after the
plaintiff and attempted to shoot
him and threatened to kill plain-
tiff; that defendant boasts that
Bhe will kill plaintiff some day;
that about the 1st of August, 193E,
defendant left home and wsb gone
for several weeks; that the defen-
dant continually tells plaintiff
that she does not love him and that
she is going to kill him to get rid
of him; that said marriage rela-
tions still exist; that defendants
actions and conduct toward him
generally are of such a nature as
to render their further living to-
gether insupportable.
That plaintiff had two children
by defendant one being dead and
one living, to-wit: A girl aged one
year and three months named Jes-
sie Ruth Newcomb; that defendant
has left home four times during
the last twelve months and each
time left the baby above named
with plaintiff; that said child is
with plaintiff now and he is a
suitable and proper person to have
the care, custody, maintenance and
education of said child. Plaintiff
prnys that said child be permitted
to remain in his custody and for
judgment dissolving said marriage
contract; that plaintiff have the
care, custody and education of said
child, and for cost of suit, and for
such other and further relief, spe-
cial and general, in law and in
equity that he may be justly en-
titled to, etc.
Herein Fail Not but have before
said Court, at its next regular
term, this writ with your return
thereon, showing how you have ex-
ecuted the same.

being an action to recover of the
defendants the sum of Twenty-One
and 48-100 Dollars as delinquent
taxes due plaintiff for the years
1926-1936, both inclusive, includ-
ing interest, penalties and costs,
tha have accrued thereon, said
taxes, interest, penalties and coets
being due upon the following de-
scribed property, situated in the
County of Burleson and State of
Texas, and within the metes and
bounds and territorial limits of
«aid* Burleson County, Texas, to-
wit:
6.2-10 acres of land out of the
Moses Cummings survey in said
County and State, and described by
metes and bounds in a deed to John
M. East, recorded in Vol. 23, p.
602 deed records Burleson County,
Texas, which record is made part
hereof for description by metes
and bounds; it is also described by
metes and bounds in plaintiff's
original petition on file in said
Court.
