A brief statement of the nature
of this suit is as follows, to wit:*
Count 1: A suit in trespass to
try title in which plaintiffs seek
to recover the title and possession
of an undivided one-half interest
in and to three tracts of land in
Burleson County, Texas, to-wit:
(1) 1920 square feet of land out
of the J. W. Mitchell League con-
veyed to Kittie Jefferson and
James Dix by deed dated Aug. 9,
1946 and recorded in Volume 95
Page 570; (2) 40 Peres of land

partition of the above described
three tracts of land, in which
I'om Evans has a 1-100 interest.
Count 8: A suit for an ac-
counting between plaintiffs and
defendants to adjust their ac
counts and interests arising out
of a l>eer parlor business estab-
lished on the first tract of land
ibove described, which has been
operated by Henry Hewett since
the death of Kittie Jefferson, and
which was established as a joint
adventure by Kittie Jefferson
and plaintiffs as is more fully
shown by Plaintiff's Petition on
file in this suit.
If this citation is not served
.vithin ninety days after the date
if its issuance, it shall be re-
turned unserved.
The officer executing this pro-
cess shall promptly execute the
same according to law, and make
due return as the law directs.
