Falcon Lake Slowly Falling
The elevation of Falcon Lake is
continuing to fall steadily during
this heat wave and drought.
A spokesman for the Interna-
tional Boundary and Water Com-
mission told The Rio Grande
Herald that the lake level Monday
morning was 274.48 feet.
This figure compares with the
following elevations: 269.53 feet,
June 1; 277.09 feet, July 1; 275.62,
Aug. 1. On Aug 18, 1985, the
elevation of Falcon Lake was 271 90
feet.
The employee indicated, "The
requests (for irrigation) are lower
than in April, May, and June
We're still getting water from
Amistad."
There has been no rainfall at
Falcon Dam since June 26. when
.48 of an inch was recorded.
Two members of the Starr
County Water Board say that
searching the statutes confirms
that entity's claim against the
county for a $65,000-plus water bill
at the city cemetery.
Both David Porras and Armando
Garcia note that Section 8 of
Article 235lf-l says, "Except as
otherwise provided by Article
235If-3, Revised Statutes, and
except as provided for counties
with a population of 8200 or less,
the trustee, the commissioners
court, and other elected public
officials of the county are hereby
prohibited from paying or using
any public funds, or using county
employees or county equipment
and property for the purpose of
maintenance and upkeep of
neglected and unkept public and
private members."
But Garcia and Porras point to
Section 9, which says, "If on Sept.
1, 1976, a county owned a cemetery
and continued to own it on Jan. 1,
1979, or if during 1976 a county used
county funds, employees, equip-
ment, or property for the mainte-
nance and upkeep of a county-
owned cemetery, the county may
continue to own the cemetery or to
provide for its maintenance and
upkeep, or both, and the prohibition
stated in Section 8 of this Act does
not apply. A county exercising the
power granted herein shall file with
the secretary of state a certified
copy of its commissioners court
certifying that such county
qualifies under this section. Such
order shall be kept in a register
entitled "County-Owned and-
Operated Cemeteries ."
The Herald was unable to reach
for comment County Attorney
Heriberto Silva, who was out of
town. The County Judge and
Commissioners were also out of
town.
