The week of May 10-16 has been proclaimed as
Emergency Medical Services Week in Slarr County.

Emergency Medical
Services Week proclaimed
County Judge J.M. Martinez, Jr.,
has proclaimed the week of May
10-16 as "Emergency Medical
Services Week" in Starr County.
The proclamation, signed by
Judge Martinez on April 28, reads
as follows:
"WHEREAS, the members of
Emergency Medical Services teams
devote their lives to saving the
lives of others;
"WHEREAS, Emergency
Medical Services teams consist of
emergency physicians, nurses,
emergency medical technicians,
paramedics, educators and
administrators;
"WHEREAS, the people of Stan-
County, Texas benefit daily from
the knowledge and skill of these
trained individuals;
"WHEREAS, advances in
emergency medical care increase the
number of lives saved every year;
"WHEREAS, the professional
organizations of providers of
Emergency Medical Services
promote research to improve and
adapt their skills as new methods of
emergency treatment are developed;
"WHEREAS, the members of
Emergency Medical Services teams
encourage national standardization
of training and testing of emergency
medical personnel and reciprocal

success, a permissible consideration
in the denial of a temporary
injunction.
"Because either of the two
theories discussed above could have
diminished the trial court's
estimation of Cano's probability of
success, we cannot say that the trial
court abused its discretion in
denying the temporary injunction.
We overrule the first point of
error."
The court added, "The test for
temporary injunctions in
whistlcblowcr actions is not, and
should not be, different from the
standard requirement that the
appellant prove a likelihood of
irreparable injury and probability of
success on the merits. To hold
otherwise would require a temporary
injunction in every whistleblower
suit of this nature."
The court continued, "Having
established the appropriate standard
for temporary injunctions in
whistleblower cases, we now
address why Cano failed to meet
this standard. He claims irreparable
injury because there is no adequate
remedy that can compensate him for
the damage to his professional
reputation if the court is not
enjoined. However, we fail to sec
how Caho's injury rises to the level
of an irreparable injury ..The injury
he allegedly suffered is no greater
than any other employee wrongly
fired for poor performance. Such
damage is properly compensated by
a monetary award, if in a trial on
the merits the court finds the Rio
Grande City Independent School
District wrongfully terminated
Cano's employment...We overrule
the second point of error."
On July 30, 1991, the board of
trustees voted to suspend Cano with
pay and to recommend that his
termination be considered at a later
meeting.

The Roma Independent School
District announces that a public
hearing for programs under the
Standard Application System
(S AS-20R93) for CHaptcr
I-Regular, Chapter II, and for the
SAS478 Migrant Program.
The hearing will be held on
Tuesday, May 12 in the Roma
Intermediate School Auditorium at
6 p.m.
Parents of children participating
in these programs are invited to
attend as well as the general public.

hearing on Cano's performance as
superintendent lasted almost live
days. On the fifth day of the
hearing, Cano's attorney elected not
to present any evidence on Cano's
behalf, instead choosing the option
of filing a lawsuit against the
RGCCISD in state district court
under the whistleblower's statute.
The hearing officer for the
RGCCISD hearings rendered his
decision in mid-October that the
board had valid cause to fire Cano.
Two days later, however, Cano
obtained a temporary restraining
order from an Austin judge that
prevented the board from acting on
his termination for the time being.
On Oct. 25, State District Judge
Jerry Dellana of Austin removed the
temporary restraining order, giving
the board the green light to act on
Cano's termination. But on Oct.
31, less than three hours before the
board was to act on the proposed
termination, Cano and his attorney
obtained a temporary restraining
order from the Third District Court
of Appeals in Austin.
