Aldermen okay ordinance on distance of establishments
At Iheir spccial meeting on
Wednesday evening, Feb. 21, the
Rio Grande City Board of Aldermen
approved an ordinance requiring
establishments that serve alcohol to
be at least 300 feet away from
schools, churches and hospitals.
The aldermen approved another
motion that adopts a distance of
1000 feet, effective upon the
official request of the school district
or other entities.
City Administrator Jose
Escamilla led off die discussion by
saying, "This would establish a
licensing fee and procedure for die
city, or one-half the rate of the
state. Three hundred feet is the
minimum."
City attorney James Darling said,
"One thousand feet is triggered by
requests, possibly at the school
district's request. You can quickly
adopt a 300-foot restriction and
adopt the 1000 feet which would be
effective when the request comes
in."
Escamilla said, "I know there is
something coming from the school
district."
Alderman Baldemar Garza asked.
"Is a business that is already
established grandfathered?" Darling
stated, "We have filed a protest
regarding the topless establishment.
On other issues, we would defer to
the expertise of the Texas Alcoholic
Beverage Commission."
Mayor Basilio Villarreal
questioned, "We did write a letter to
Liquor Control?" City Secretary
llolly Guerrero said, "We called to
ask the status concerning the
re-application for liquor license.
The school district also protested."
Darling indicated, "It was a beer
and wine license." The aldermen
then approved a motion setting the
minimum distance at 300 feet,
effective immediately. The aldermen
then approved another motion
calling for the minimum distance to
be 1000 feet upon a request to that
effect from the school district or
another party.
Concerning proposed rates for
Central Power and Light, Darling
said, "CPL filed a request for rate
increase of $75 million. Our
steering committee (of
representatives of cities in the CPL
service area) has advocated not only
that the $75 million request be
denied, but that -ales be rolled back
by $54,362,000."
Darling added, "If die cities adopt
this, CPL will appeal this to die
Public Utility Commission and a
decision is requested by November.
Other cities have adopted such
resolutions." The aldermen
approved die motion supporting thi
proposed rollback in rates.
Alderman Garza abstained,
indicating that this action was due
to legal work involving CPL.
Concerning an application for
juvenile alternatives, Escamilla
said, "This is funding for a juvenile
law officer." Police Chief
Guadalupe Marquez declared, "We
need to provide $450, plus
uniforms. Next year il would be
80/20." The aldermen approved a
motion favoring the proposed
application.
The jjrant application for juvenile
alternatives is destined lot the
Criminal Justice Division of the
Governor's Office. If the grant
comes through, it will be
administered by the South Texas
Development Council.
Escamilla declared, "Down the
road, we'll need to provide
equipment. We can take further
action at later meetings. Tin
vehicles would involve up to
$87,000. The Governor's Officc
would provide 100 percent the liist
year."
Marquez indicated, "We don't
know yet if it will be approved. If
it's approved this year, there's no
guarantee about future years."
Escamilla noted, "This merely
