An Act relating to re-employment of retired auxiliary school employees; pro.
viding that they may be employed on a substitute basis for a period not to
exceed eighty (80) days in any one school year; providing a penalty for
employment in excess of eighty (80) days; and declaring an emergency.
Be it enacted by the Legislature of the State of Texas:
Section 1. Any auxiliary employee retired from service under the
Teacher Retirement System of Texas and receiving benefits under the
System may be employed, on a part-time, day-to-day basis only, as an aux-
iliary substitute in the public schools or in fully or partly State-supported
institutions of higher education for a period not to exceed eighty (80) days
in a single school year without affecting existing benefits under the Re-
tirement System, including the right to receive retirement allowance. Any
such person who reports for duty as a substitute auxiliary school employee
during any day and works any portion of the day shall be considered to
have worked one day. The substitute employment does not entitle the
person to additional creditable service under the Retirement System.
Sec. 2. Any retired person who exceeds eighty (80) days of substitute
work, or who is again employed in any position in the public schools of
Texas, shall, except as provided in Section 1 above, forfeit all retirement
benefits for any month in which such employment occurs.
Sec. 3. The fact that retired auxiliary school employees possess spe-
cial skills which may be utilized in periods of emergency to provide con-
tinuous, effective operation of the school plant and program and that such
persons are not now available for substitute duty creates an emergency
and an imperative public necessity that the Constitutional Rule requiring
bills to be read on three several days: in each House be suspended, and
said Rule is hereby suspended, and that this Act shall take effect and be in
force from and after its passage, and it is so enacted.
Passed the House April 17, 1963, by a non-record vote; passed the Sen-
ate, May 2, 1963, by a viva-voce vote.
Approved May 18, 1963.
Effective 90 days after May 24, 1963, date of adjournment.
