Texas, dated March 17, 1937, recorded in Volume 343, Page 69, Wichita
County deed records; said 3.84 acres of land, more or less, including
streets and alleys and being portions of lots 11, 12, 13, and 14, Block 12:
all of lots 1, 2, 3, 4, 5, 8, 9, 10, 11, 12, 13, and 14, and portion of 6 and 7 of
Block 13; and portion of lots 1, 11, 12, 13, and 14, of Block 14 of said addi-
tion and more particularly described by metes and bounds as follows:
BEGINNING at the Southwest corner of Block 13 of the said J. A.
Kemp Subdivision, said point being the intersection of the East boundary
line of Virginia Avenue and the North boundary line of Waco Street;
THENCE, N 00 03' W, along the East boundary line of Virginia Ave-
nue, also being the West property line of the said State of Texas property,
a distance of 420.63 feet to a point for corner;
THENCE, N 17 44' E, a distance of 62.0 feet to a point for corner;
THENCE, S 89 59' E, a distance of 79.55 feet to a point for corner;
THENCE, S 490 12' E, a distance of C5.04 feet to the beginning of a
curve to the left whose radius is 1959.86 feet and the bearing of the tangent
to the curve at this point is S 40 26' E, said point being in the Southerly
boundary line of E. Scott Avenue;
THENCE, in a Southeasterly direction along the arc of said curve, said
arc of curve being the Westerly boundary line of E. Scott Avenue and also
being the Easterly property line of the said State of Texas property, a dis-
tance of 621.49 feet to a point for corner; said point being the intersection
of the Southerly boundary line of E. Scott Avenue and the West boundary
line of lot 10, Block 14 of said addition;
THENCE, S 00 08' E, along the West boundary line of said lot 10, a
distance of 29.14 feet to the Southwest corner of said lot 10, said point
also being in the North boundary line of Waco Street;
THENCE, S 89 43' W, along the North boundary line of Waco Street,
also being the South property line of said State of Texas property, a dis-
tance of 615.08 feet to the place of beginning. Containing 3.84 acres, more
or less.
Sec. 3. This land shall not be conveyed to any person or entity, other
than the City of Wichita Falls, for a period of one year after the effective
date of this Act. If, at any time during such one year period, the Commis-
sion tentatively agrees that it shall purchase it, at an agreed price not
less than the fair and reasonable value of the State's interest in such land,
the Commission shall recommend to the Governor that he convey to that
City the State's interest in the land. The Governor may convey this land
upon such recommendation.
Sec. 4. If the Commission and the City of Wichita Falls fail to agree
to a tentative contract of sale concerning this land during this one year
period, the land shall be sold by sealed bid in the manner required by law.
Sec. 5. The importance of this legislation and the crowded condition
of the Calendars in both Houses create an emergency and an imperative
public necessity that the Constitutional Rule requiring bills to be read on
three several days in each House be suspended, and this Rule is hereby
suspended.
Passed the House, April 30, 1963, by a non-record vote; passed the
Senate, May 9, 1963: Yeas 31, Nays 0.
Approved May 21, 1963.
Effective 90 days after May 24, 1963, date of adjournment.546
