From these statutory provisions, aM dCr that
part of the appropriation act relating to the Depsrtment
of dSsastion, it is our opinion that the ite or freight
on new textbooks is more definitely specified rather as
a part of the cost and distribution ot textbooks than as
a contingent expense, and for this reason payment of such
freight should be paid from the textbook fund and ot
from the contingent expense it or fud.
The exress mention of "used textbooks in the
maintenance and r soellaneous item above quoted does not
argue against this conclusion, but rather it favors eah
conclusion. I the aegislaturhad contemplated that
freight on new textbooks should be consiAered as a con-
tinren Itpmos it ost likely would have msentel
such frei gt spetLif lly, seeing that it hat in mita
and coansderd the matter tof 'eights. Its omsion of
freights on now textbooks, therefore, argues that audh
freight on new textbooks wou l mere properly oom under
the head of przohase an distribution of textbooks, and,
therefore, be payable out of the tetbook fund.
For the reasons here given, and heretofore
given in our opinions above referred to, we answer
your inquiries as above ir neatd.
