[By the act of February 9, 1881, the supreme court was authorized to
refer civil causes for examination, and report to the commission of
appeals, and the opinion of the commission, when adopted by the
supreme court, was required to be published among the opinions of the
supreme court. In this volume will be found many opinions of the commission,
the indorsement of adoption on each opinion being omitted in
