Milton Yarberry' was about 41 years of

unprepossessing in appearance. He was a
native of 1'e.xas and spent most of bis ear-
ly life at Decatur Wise county. Milton
was a cowboy rouh and gambler. He
got Into a difficulty with a freighter killed

There he met the notorious desperadoes
Davo U'idabaugh and Dave Matthews and
joined lliem in the robbing business. Kear

er who refused to he robbed. The trio then

to Las Vegas lucre in connection with a
Mexican woman wbo went by tno name ot
"titeamboit" he ran a dance hall which
proved a flnuiicial failure and Yarberry
moved to this front of tbe railroad which at'
that time had not reached Albuquerque.
About ths time of bis leuving a
freighter was killed aud robbed of $700
nenr Lm Vogas Yarberry was suspected
but there was no proof that he bad com-
mitted the crime. Next Yarberry was at
Albuquerque with his pockets full of
money. At that time tbe new town was
just being organized and Yarberry came
to the front us a politician and was ap-
pointed constable of the Drecinct. In a
short lime he killed Henry Brown of Nash-
ville Tennessee but througl the incapac-
ity ol the jury was acquitted. Having got-
ten off 60 easily he thouubt it would be no
caufie of complaint it he Killed whomsoever
he chosu and coon after his acquittal for
the Ilrown murder he shot aud killed
( liarh'S Campbell a carpenter employed at
tbe Atluntio & i'acilic yards. There has
never been a reason given why he killed
Campbell not even knowing tbe man.
He shot horn in the back and soon boasted
of his deed. Hud it not been lor a strong
movement on the part of tbe business men
of the city Yarberry would bavebeenjuung
at the time of this murder hut better
judgment prevailed. Thus another one of
the gang of "Hilly the Kid'' has run his
course.
A newspaper recuived by an acquaintance
ol the doomed man gives the following ac-
count of

"At fifteen minutes before 3 o'clock Chief
Howe read the death-warrant. . Yarberry
during the reading kept his eye on the olll-
cer constantly and seemed not at allaflected
by it. After it had been concluded he stood
erort and eyeing the crowd that faced him
spoke as follows: " i'ou are going to hang
Mill Yarberry. You are going to hang him
not for the murder ot Campbell but lor the
killing of Urown. There is Colonel Bell
nninting him out araoug the crowd what
did no say? - Come around Bell so
I can see you don't hide your
face. What did he say to Sheriff
Whi'cliiU when he asked him what was
done with the duputy sherid' that killed
Campbell. Bell laid 'be is In the Santa Ke

Yarberry a reward for killing such a char-
acter. Brown struck town as a bad man.

sucu means; out every nonesi man ac-
quainted with our district land mutters;

tempting a power to be placed in any one
man's hands. It has practically amounted.

lands from the humble man of small

never been surveyed into sections and
marked nor the streams meandered or

no means of determining the boundary of
any particular section or what is and what
