Dkau Sin: I have the honor to
acknowledge yours of the25lbult. and
regret the disappointment to which
some of the recruits or North Caroliua
have been subjeuted. I concur with
you ua to the policy o! allowing the con-
scripts - as far as the slate of
service will permit to select
the companies and regiments in which
they are to serve. Tho right secured by
law of a volunteer to select his own
company was lost. It ia true that
by enrollments tlie policy was so
obvious of associating men together
who would best harmonize
with euch other that it was my purpose
to continue tbe privilege beyoud tbe
limit lixed by law. The danger to the
coast of North Carolina aud our inabil-
ity to draw troops from the army of
uoitheru Virginia rendered it
proper that the greatest exertion
suould be made immediately to
till up tho regiments in (Jen. French's
command but this did not luterlere
with allowing conscripts to select
among those regiments to which they
would be assigned so long as vacancies
. . i ni.
existed In tne companies vuunuu
aud that I expected would have been
done. I will send ycur letter to the
war department with a copy of this re-
ply to you and hope lor tho future there
will be no ground for dissatisfaction
aud that as far as is fuasihle the
appointments to which you re-
fer may be corrected by transfer.
I feel giaieml lo you for tho cordiul
manner in which you sustained every
proposition couueoted with the public
defense aud trust there will always be
such co-intelligence and accordance
as will enable us to co-operate for
tho publiu good. Tho conscript
act has not been popular
anywhere out of the army. There as
von Hrn aware: it servos to check tbe
discontent which resulted from retain-
ing the twelve months men beyond the
term ol their original engagement aud
was fairly regarded as a measure equi
tably to distribute tho burden of
public defence; but state authorities
have nowhere offered opposition to its
executive or withheld their aid except
iu ths state of Georgia aud so fur as the
cadets of the Military institute are
concerned in the state ot Virginia I
shall endeavor by judicial decision to
settle tho question raised on those two
states and in the meantime I have been
cheored by the evldenoo o the popular
sentiment which supports any measure
necessury to protect oiir country and
secure our political Independence. Like
yourself I have hop9d that party dis-
tinction which existed at a former
time would be buried ill the graves
of the gallant men who have fallen in
defense of their birthright and that we
should all as a baud of brothers strike
lor tbe inheritance our lathers left us.
With sincere ' regards I am respect-

awakened by some one calling ber bus-
baud by his First name (ieorge and tell-
ing him they wanted him to show them
the road; that when bo opened the door
he wat shot down and tho shoolinu
continued for about lilteen minutes;
tuut she got out of bed ami crawled un-
der tbe bed; that when te p'rtles who
committed the murder li ft t-he ran out
and went to a neighbor's and did nut
return unlil nextinnruing; the murdered
muu bad sixteen wounds; ulso that tne
negro church was burned the same
night that berhuxbaud was killed.
The next important testimony for the
stale was thut ot'Lieorge Belk who was
indicted for the same oftunse and for
burning the church. He testified that
Charles Cox and himself Btayed at Alii
sou's house that night: that ho (Belkl
was so drunk he fell off of his horse and
that Cox and Allison carried him into
the house and put him to boil; that be
woke up during tlio night and found
that be was alone in the house and that
he went out to tho horse lot and found
his horse anil saddle gone;
also his hat and overcoat.
That he went back to bed and was
wakened later in the night by Alison
and Cox coming in and telling him that
lie hud missed tiie fun as they bad
burned a church and killed a negro;
that they then built a fire and burned
the shoes thov had worn having left
their boots at tbe house when they
went off.
The defense rested on the testimony
of a female cousin of tlio defendant who
dved about twenty-live vards from de-
fendant and who was up all night with
her sick mother. She testifl-d that she
uiw trom hi'Mvinir hi in around mid
his cotninir to the house several times
during tbe nigiu to inquire and assist
about her mother; that he was not away
that night. J un v nson a tenant 01
the defendant's testified that ho was at
Allison's house until 11:1 p. 111. auu
that when he left HelK. and uox were
both down drunk and that he left them
as All'son told him he could manage
Belk and Cox now as no nan iiioni
clown and on the fact that Belk had laid
r.i.n months In iuil on this charge and
did not say anything ahoutAllisun being
connected with it until souietiuio after
be was released on bond.
