The appropriation for travel made hereinabove is contingent upon
the filing of a report with the Operations Analysis Division of the
Governor's Office and the Legislative Budget Board, showing the Depart-
ment allocation of travel funds to each division therein and the subse-
quent filing of quarterly travel expenditure reports accurately
reflecting travel funds expended. Such quarterly reports shall be
cumulative, reflecting the allocation to each division, expenditure by
division, the unexpended balance, and reallocation, if any, of such
balance. Reports shall be filed within twenty (20) days after the end
of each quarter.
The line items position above entitled "Director of Hearings" shall
be an attorney licensed to practice law in the State of Texas and the
person filling such position shall be approved by the Attorney General.
The Comptroller of Public Accounts shall issue no salary payments for
this position until notified by the Attorney General that such approval
has been made.
None of the funds appropriated for the positions authorized above or
that may be authorized to the agency through any other procedure shall be
used for operating intelligence or undercover activities which are not
for the direct and sole purpose of enforcing the provisions of the Texas
Liquor Control Act.
It is further provided that such refunds of taxes, permit fees, or
license fees as are authorized to be made under the provisions of the
Texas Liquor Control Act, or by any amendment to said Act, may be made
from proceeds derived under provisions of said Act before such proceeds
are allocated to the respective funds as provided in the Act; and so much
of such proceeds as may be necessary for the payment of such refunds is
hereby appropriated therefrom for the payment of refund claims for the
fiscal years ending August 31, 1972 and August 31, 1973. (The amount of
such refund is estimated at $200,000.)
The revolving change fund created by prior Legislatures in the
amount of $3,000 for use at the several International Bridges for change
funds is hereby reappropriated for the biennium beginning September 1,
1971 for the same purposes.
No other provisions of this Article shall prevent payment by the
State of Texas of salaries and expenses incurred by representatives of
the Texas Alcoholic Beverage Coammission in attendance on State or
Federal grand jury proceedings, and who say be called as witnesses in the
trial of criminal or civil cases in State or Federal Courts involving
offenses complained of against State or Federal liquor regulatory or
revenue laws. It is further provided that any fees collected by such
representatives in performing such duties shall be deposited in the state
Treasury to the credit of the Travel Expense ites included herein.
