time within a year Mark Rico has been
declared guilty by a Jury bt his peers
of the murdoi1 bf LhciUB Phelnn tho
rfccnml Verdict that consigns Rlcj to
tho penitentiary for llfo having been
rendered nt 4 o'clock this afternoon
On tho first trial beginning Juno 17
iSOC and ending Juno 29 Rico was
sentenced to death. On appeal this
sentence Was nffirtned but a rehearing
was secured tho higher court this tlmo
reversing itself and granting Rico a
new trial. This second trial ended to-
day. What further move will bo made
to savo Rico has not been disclosed
On Jan. 6 190G jRIco shot and killed
Lucius Phelnn a Waco saloon man
following a quarrel In Thelan's bar
room.' On both trials Rico pleaded
self defense but tho ovldenco failed to
sustain this plea. Rico is a bartender
by occupation 38 years of age and tho
son of a well to do retired merchant
of this city.

the Duke auditorium this afternoon

commissioners court to order a local

NOCONA Oct 27. A severe hall and
Windstorm swept through the famous
Red river valley about ten miles north
of Noconaj between 7 and 8 o'clock
Friday evening. Reports from that
section tell of great damage to crops
and livestock caused by the hall. The
path of the storm was from one to twd
miles in width and so far as Tcnown
here extended for about eight miles 4
In an easterly direction The hall was
terrific and in many places stood
several Inches deep after the storm
had passed. The Red river vallev Is
J the richest farming district of Mon
tague county and the loss to the un-j
gathered crops .-will be heavy. Cotton
was late In this section and owing to
the scarcity of pickers the farmers
were badly behind with "their picking;
The. wind also -did considerable dam
age. The home of Henry Clark was 1
completely demolished. Several other.
houses were more or less damagea
but so far as learned no one was hurt
Several stalks of cotton Irom the
storm-stricken district vrere exhibited

remained on the stalks.
