the 8th day of October, A. D. 19-18,
at 10:00 o'clock A. M., and at
Rusk, in the county court room,
in the county of Cherokee, State
of Texas, the undersigned, special
commissioners appointed by the
special judge of the county court
of said county to assess the da-
mages occasioned by the condem-
nation of the following described
property, to-wit:
For the purpose of constructing
a sewer disposal unit and plant
on the following described prop-
erty:
Situated in the T. G. Timmorts
Survey, Cherokee County, Texas,
and being a part of the same land
conveyed to I. N. Langston by L.
D. Funderburk by deed of record
in Vol. 76, pagfc 246, Deed Records
Cherokee Co., Texas; Beginning
in the center of One Eye Creek at
the NW corner of the J. W. Sum-

For laying a sewer line and
power line from the Town of Rusk
to the sewage disposal unit, the
following described land;
A tract or parcel of land being
30 ft. wide, the center line of
which is described and situated
as follows:
Situated in the T. G. Timmons
sur., Cherokee Co., Texas, and be-
ing a part of the same land con-
veyed to I. N. Langston by L. D.
Funderburk by deed of record in
Vol. 76, page 246, Deed Records,
Cherokee Co., Texas
Beginning at a point located
eight-nine ft), from One Eye
Eye Creek and on the N. E. boun-
dary line of the boundary survey
of a 2 32-100 acre tract to be
used as a disposal plant site, which
site was surveyed by Thomas
Shearon, County Surveyor, Cher-
okee Co., Texas. Date of the above
mentioned survey was April 20,
| 1948. The center line of the pro-
i posed 30' right-of-way needed be-
: gins at the above mentioned point
and is described as follows:

For the purpose of constructing
and laying out a certain right-of-
way to be used for servicing the
above described sewage disposal
unit.
Being 40 feet wide, the center
line of which is described as fol-
lows:
Situated in the T. G. Timmons
Survey, Cherokee County, Texas,
and being a part of the same land
conveyed to I. N. Langston by L.
D. Funderburk by deed of record
in Vol. 76. page 246, Deed Records
Cherokee County, Texas.
Beginning at a point 20' N. 28
degrees 15' E. of a corner post
which is described as a boundary
corner of a ifoundary survey of a
proposed sewage disposal plant
site, which survey was made on
April 20, 1948, by Thomas Shear-
on, County Surveyor, Cherokee
}County, Texas.
Thence S. 86 degrees 00' E. ap-
proximately 1490 feet, at which
point an intersection with the
east boundary line of the I. N.
Langston tract is made, all of
which more fully appears in a
certain written statement filed
by the said Town of Rusk with
said judge on the 17th day of Au-
gust, 1948, to which reference is
here made, having heretofor duly
