OUR CALENDAR tells us that Tuesday,
March 20, was the first day of spring . . .
when the equinox arrived. We always un-
derstood that the 21st was the opening of
spring, but some of our astronomers have turn-
ed to nit-picking, and now they clock the
equinox to the second, and sometimes it comes
on the 20th and sometimes on the 21st.
Anyway spring is here officially, and in all
probability our freezes and frosts are over,
It's been a wet, cold, snowy winter, and we
have a good season in the ground, and things
are growing. The grain fields are really
greening up.
WE CHECKED our neighborhood mesquif.e trees
and a few are putting out leaves. In West Texas,
so the old timers tell us, this is a sure sign that
the bad weather is over. In the Northeast part of
the U. S. they have their ground hogs. In West
Texas we have our mesquite to verify the arrival
of spring.
Incidentally, we have a black walnut tree in
the yard that doesn't believe spring is here. It
shows no signs of life thus far.
THE LENT SEASON is here, and Easter is
a month away... Easter is late this year, com-
ing on April 22. If we have an Easter spell
this year, it's surely going to do a lot of dam-
age to lush late April vegetation.
A whole week of school was lost during the
January snow storm and some school days are
to be made up at the end of school. The lo-
cal school is enjoying spring vacation this
week.
CITIES AND SCHOOLS are to have elections
on April 7, to name councilmen and trustees. In
Albany, we note, there are no contested races.
The City of Albany will name a mayor and two
councilmen, and there are four school trustees to
be elected.
Lack of a contest for these elective positions
tell us that our people are well pleased with the
actions of the city and school district.
THE NEWS Is carrying some interesting
stories about the founding of churches in Al-
bany. Mrs. Clifton Caldwell, member of the
Historical 8urvey Committee in Albany, is
doing the research for her committee, and lets
us carry her stories. Early settlers establish-
ed their churches soon after coming to Albany
and these churches have been an integral part
of the life of the community over the years.
The Methodist Church is observing its 100th
anniversary here this year, and the Presby-
terians are Just a few years younger.

THE CITY OF ALBANY Is doing a lot of street
patching this month. Winter ice storms caused the
pavement to buckle up and disintegrate. The
highway department had the same problem.
The city owns its street paving equipment, and
the employees have the people's thanks for their
good work.
We are writing this to thank Liston and his
employees for giving us a hand behind the post
office, lione Star Gas office, News office and Dr.
Howie's office. The winter left some big chug-
holes In. the pavement
Be the way, we wrote "chug hole," arid we like
the word We understand the correct term for the
big hole in Ihe street Is "chuck-hole."
BOH TllliEY, nuinitgrr of the social securi-
ty office In Abilene, came over Tuesday to
present The Albany News a "Certificate of
Appreciation" for "the outstanding manner in
which you have helped to publicize social se-
curity news throughout your years as editor-
publisher of The Albany News."
The certificate Is greiilly appreciated and
will go Into our treasure chest.
Along with Ihe certificate was a letter from
Waymnn K. Register, regional commissioner
of Social Security expressing his appreciation
, for publicity In the News, lie writes, "For all
the help which you have given, for all the peo-
ple you have helped to reach through your
printing of news about social security, for
your special editorials, und for your very
courteous treatment of our Abilene manager,
Bob Tuley, and Ills slaff, I wish to express my
thanks. May your retirement years be many
and happv."

PRISONERS AT LARGE!
Security was so lax at a state
penitentiary that prisoners could
get whLskey, t drugs, and even
guns without too much trouble.
Y One night a hardened criminal
Stole a gun and made good his
escape.
He was recaptured within a
few hours, but not until he had
invaded a nearby home and shot
a housewife in the leg. In due
course, she demanded damages
from the stale.
"They run that jail loo car-
lessly," she charged in court.
"Escapes arc common. Further-
more/ they knew that, this par-
ticular criminal was dangerous.
Therefore Ihe government is to
blame for my being shot."
The court agreed, and the
woman won a substantial ver-
dict.
Injuries inflicted by escaped
prisoners are leading to a grow-
ing number of damage claims
against either prison officials or
the state itself. The law says
penal institutions must be run
with fair regard for the safety
of those outside th wails.
Nevertheless, authorities are
not to blame if the escape could
not reasonably have been pre-
vented. Nor are they liable, even
though negligent, if the injury
to the outside citizen was not
reasonably foreseeable. Thus:
Another escaping prisoner,
commandering a passing auto-
mobile, caused the driver to suf-
fer a fatal heart attack. But in
this case the prisoner had a good
record, with nothing to forewarn
officials that he could be danger-
ous if he got loose.
Accordingly, when the vic-
tim's family filed suit for dam-
ages, Um court turned them
down.
What If an escapee steals a
car and then, driving recklessly,
knocks down an Innocent pedes-
trian?
In such circumstances courts
have generally rejected the vic-
tim's claim for damages, even
though prison officials were to
blame for the escape. Reason:
although officials should have
foreseen thai the prisoner might
run away, I hey could scarcely
have foreseen that he would also
be a bad driver.

THE STATE OF TEXAS
COUNTY OF SHACKELFORD.
On this the 8th day of January,
1973, the Board of Trustees of
Albany Independent School Dis-
tiict convened in regular session,
opsn to the public, with the fol-
lowing members present, to-wit;
l-oren Williams, President, Mrs.
Harold Law, Clifton Caldwell,
Bill Hicks, James Lenamon,
Gerald Petree., and the following
absent: Bob Waller, constitut-
ing a quorum and among other
proceedings had by said Board
cf Trustees was the following:
WHEREAS, the term of office
of Loren Williams—Place 3, Clif-
ton Caldwell—Place 4; Gerald
Petree—Place 5; and James
Lenamon—Place 2, members of
the Board of Trustees of this
School District will expire on the
first Saturday in April, 1973, said
first Saturday being April 7,
1973, and on said date a trustee
election will be held in said
School District.
WHEREAS, it is necessary for
this Board to pass an order es-
tablishing the procedure for fil-
ing fur and conducting said trus-
tee election:
THEREFORE, BE IT ORDER-
ED by the Board of Trustees of
Albany Independent School Dis-
trict:
1. That an election be held in
said School District on April 7,
1973, for the purpose of electing
to the Board of Trustees of said
School District members to fill
positions in Place 2, 3, 4 and 5.
2. That all requests by can-
didates to have their names plac-
ed upon the ballot for the above
mentioned election shall be in
writing and signed by the can-
didate and filed with the secre-
tary of the Board of Trustees at
the superintendent's office not
later than 30 days prior to the
date of said election.
All candidates shall file with
said application the loyalty af-
fidavit required by Art. 6.02 of
the Election Code.
The Secretary of this Board of
Trustees shall post on the bulle-
tin board in the building where
the Board of Trustees meets the
names of all candidates that
have filed their applications in
accordance with the terms and
provisions of this Order, and
said Secretary shall otherwise
comply with the terms and pro-
visions of Art. 13.32 of the Elec-
tion Code. k .
3. That said, election shall be
held at the following places, and
the following named persons are
hereby appointed officers for
said election:
(a) In election precincts num-
bered at Depot Community Cra-
ter Building, in Albany, Texas,
in said School District, with Mrs.
Bill Couger as Presiding Judge
and Mrs. John Grothe and Mrs.
Robert Mayfield, Clerks.

The polls at the above desig-
nated polling place shall on elec-
tion day be opan from 7:00
o'clock a. m. to 7:00 o'clock p.
m. i •
4. Mrs. Ruby Moore is hereby
appointed Clerk fojr absentee vot-
ing, and Mrs. John Williams and
Mrs. Baker Matthews are Here-
by appointed Deputy Clerks for
absentee voting. The absentee
voting for the above designated
. election shull be held at Office of
District Clerk, County Court-
house within the boundaries of
tho above named School District
and said place of absentee vot-
ing shall remain open for at
least eight hour! on each day
for absentee voting which is not
a Saturday, a Sunday, or an of-
ficial State holiday, beginning on
the 20th day and continuing
through the 4th day preceding
the dale of said election. Said
place of vol In;: shall remain open
between the hours of 8:30 a. m.
and 5:00 p. m on each day for
said absentee voting. The "above
deseril)cd place for absentee vot-
ing is also (he absentee Clerk's
mailing address to which ballot
applications and ballots voted by
mail shall be sent.
6. The manner of holding said
election shall be governed, as
nearly as may be, by the Elec-
tion Code of this state, and this
Board of Trustees will furnish
all necessary ballots and other
election supplies requisite to said

7. Immediately after the votes
have been counted, the officers
holding said election shall make
and deliver the returns of said
election and perform all other
duties as provided by the Elec-
tion Code.
8. The Board of Trustees shall
give notice of said election, and
this combined Election Order
and Notice shall serve as Notice
for said election. The President
of the Board of Trustees is here-
by authorized and instructed to
post or cause to have posted said
combined Election Order and
Notice at three public places
where notices are customarily
posted in this school district, and
said posting shall be made at
least 20 days before the date of
said election.

Said publication shall be not

than 10 days before the date of

9. It is further found and de-
termined that in accordance with
the order of the Board of Trus-
tees the Secretary posted writ-
ten notice of the date, place and
subject of this meeting on the
bulletin board, located in the ad-
ministrative office, a place con-
venient to the public, and said
notice having been so posted and
remained posted continuously
for at least 3 days preceding the
date of this meeting.
It is further found aQ(l de-
termined that this district is lo-
cated in Shackelford county and
that written notice of the date,
place and subject matter of this
meeting was furnished to the
County Clerk of the county in
which this district is located and
that said notices were posted by
the County Clerk of the county
on the bulletin board at the door
of tha county courthouse for said
county, a place convenient to the
public, at least 3 days preced-
ing the date of this meeting. The
returns of said posting shall be
attached to the minutes of this
meeting and shall be a part
thereof for all intents and pur-
poses.
The above order being read, it
was moved and seconded that
the same do pass. Thereupon,
the question being called for, the
following members of the Board
voted AYE: Mrs. llarold Law,
Clifton Caldwell, Bill Hicks,
James Lenamon, Gerald Petree,
and the following voted NO:
None.
