MONTAGUE - The
county commissioner's court
clarified, as much for them-
selves as for others Monday,
the protocol to be followed
when local fire departments
need assistance from county
resources.

Sappington of Lake Nocona
explained he put the item on
Monday's agenda because
County Judge Ted Winn
found himself caught
between immediate requests
for help and no procedure to
meet those needs.
Specifically, on Jan. 23 a
grass fire off Oak Shores

into a 1,000 acre beast that
saw a dozen fire departments

visiting District Judge David
Cleveland in the 97th
District Court.
Leonard Rubio Jr., 17, of
Saint Jo was sentenced to
three years probation and
fined $750 for the burglary
of a building belonging to
William Scott.
Terry Wayne Caudill, 29,
of Bowie, was sentenced to
three years with the Texas
Department of Corrections
for the burglary of a habita-
tion belonging to Gene
Hutson.
Penny Yarbro, 52, of
Saint Jo, was sentenced to
two years probation and
fined $500 for possession of
a controlled substance.
And Jessica Ross, 31 of
Wills Point, was sentenced
to five years probation and
fined $1,000 for credit card
abuse.

Along the way, fire trucks
began running out of fuel,
and Judge Winn - ever ready
to lend help, as are many
other retired volunteer fire-
men - was asked to get them
fuel.
"Ted needs some guid-
ance from the court," the
senior commissioner
explained noting the issue
came up when the bill for the
fuel hit the auditor's desk
and the questi9on became
"Where do we take the
money?"
The commissioners
resolved that question by
splitting the bill equally
between them.
County Emergency
Management Coordinator
Kelly McNabb of Nocona
was asked for his input on
the matter.
Commissioners quickly
agreed to volunteer their
services to help refuel fire
trucks during "major fires"
like the Lake Nocona fire or
the Ringgold Inferno, among
others.
"If the fire departments
need help, they need to ask
Kelly," Sappington said.
"Then Kelly can contact us
for fuel, and if the (fire
departments) need help from
the Texas Forest Service,
that request has to come
from the county judge."
McNabb asked about bull
dozers. While the commis-
sioners were willing to loan
their equipment, they were
reluctant to put their road
crews in the fire's path.
"They aren't trained for
that," Pet. 1 Comm. Jon
Kernek observed.
McNabb told the court
that the Texas Forest Service
was willing to put on a fire
fighting training class for
bulldozer operators.
Commissioners noted
several of the county's heavy
equipment operators, like
Tony Barger of Nocona,
Sappington observed, often-
times bring their dozers out
to help cut fire breaks at no
charge to the county or the
fire departments.
But there have been times
the county has gotten "fairly
substantial bills" from dozer
operators for fighting fires.
Pet. 3 Comm. Steve
Howard of Nocona said he
would like to be trained in
how to safely use a dozer
during a fire, and he wants
his road hands trained as
well.
The commissioners
agreed to think about the
dozer question and come
back at a later date to clarify
that policy for McNabb and
Judge Winn.
"It looks like we need to
put a lot of thought into
this," Sappington observed.
In other action Monday,
Kernek agreed to sell his
share of the Road District 1-
2-3 Joint Equipment's rock
crusher to Precincts 2 and 3.
Each of the two precincts
would make two annual pay-
ments of $18,750, the first in
2010 and the second in 2011,
to Precinct 3 for a total pur-
chase price of $75,000.
"Our crusher, it's just
small," Pet. 2 Comm. Jerry
Clement of Bowie observed.
"It hardly makes enough
rock for all three precincts."
Kernek added he would
be willing to "help them out"

and purchase rock from the
Precinct 2-3 operation "once
you get a little ahead". But
"that's going to be a long
time before they get caught
up," he observed.
Sappington received per-
mission to take bids 47
pieces of 33- and 36-inch
steel pipe of various lengths.
"I'm going to keep the 60-
foot stuff for emergencies,"
he added.
The court also accepted
the bid from Sanford Oil
Company, Ashley & Duval,
of Bowie for fuel and diesel
for the next year at $ 1.4349
per gallon for unleaded gaso-
line and $1.3397 per gallon
for diesel.
