AN ORDINANCE
' (No. 27.)
relating to the public acequia in the
city of hij paso, the use op the wa-
ters from said acequia, the prices
to be paid therefor, etc.
Re it resolved by |the city {. council of
the city of El Paso:
ejection 1. That the office of acequia
commissioner be and the same is hereby
created.
8ec, 2, That the city council may, al
such time as it may deem advised, ap
poiDt an acequia commissioner who shall
bold his office at the will of said city
council, and the said acequia comm s-
sioner shall receive such salary, or com-
pensation, as the city council may pre-
scribe at the time of his appointment, i
Sec 3. It Bhall be the duty of said
acequia commissioner, or city assessor
and collector to make complaints against
all persons who uee Ihe water of the ace-
quia in violation of the provisions of this
ordinance.
bsc. 4 That the following annual tax,
or rates, are hereby imposed up in, and
shall be collected from the consumers of
the water of said acequia, viz:
For each lot of land 26x120 feet (four
or less lots to one person) 11.50.
For each lot of land 20x120 feet (five to
ten lots to one person) $1 25.
For each lot of land 26x120 feet (eleven
to twenty lots to one person) $1.00.
Lots of greater or less square feet shal.
be paid for in proportion.
Hardens, per acre, $5 00,
Agricultural purposes, per acre $2 50.
Domestic purposes, for family of not
more than five, 11 00.
Domestic purposes, for family of over
five, 12 00
For brick making, per thousand, 5 cts
Laying bricks in wall, per thousand,
2} cts.
For making adobes, common size, per
thousand, 85 cts.
For laying adobes in wall, per thou-
sand, 15 cts.
For watering horses, cattle and asses,
per head, 50 cts.
For watering sheep or goats, per head,
10 cts.
For all other purposes, per thousand
gallons, (amount to be estimated by the
acequia commissioner or assessor and
collector) 25 cts.
J-rovided; that the city assessor and
collector may, at any time, with the con
sent of the acequia committee, make
special rates for the use of said water, per
thousand gallons, for purposes other than
those specifically designated herein.
Sec 5. That the actquia commission
er Shall hive general charge and control
of said public acequia, and it is made the
duty of said acequia commissioner, or
the city assessor and collector to prose
cute all persons using the water of the
acequia without first paying therefor, or
without first complying with. Or who
shall in any manner violate any of the
provisions of this ordinance.
t>EC. 6 That it is hereby made the
duty of the city assessor and collector
(and for that purpose he is hereby au
tnorized) to collect all moneys imposed
as a tax or rate upon the consumers of
said water; and upon receiving said
money, the said assessor and collector
shall execute and deliver to
the contumer so paying, a
receipt therefor; and said money
so received, shall be at once paid over to
the city treasurer, by him to be applied
to the credit of the acequia fund; and it
is hereby made the duty of said assessor
and collector to keep a receipt book,
which (hall be the property of the city,
and which shall contain a duplicate of
each receipt delivered to the consumers
of the waters of the said acequia.
Skc 7 Thai it shal be unlawful for
any person to take any water from said
acequia without first having paid the tax,
or rate, herein imposed; and any person
who shall, in any manner, use, take from
or consume, any water from said act quia
without first having paid such tax or
rate, shall be deemed guilty of a misde-
meanor, and upon conviction tnereof,
shall be fined in any sum not lesa than
one dollar, nor more than fifty dollars..
*B*c. 8. That it shall be onlawfol for
purpose whatever, without first having
obtained the permission of the city as:
sessor and collector, or acequia commis-
sioner; and any person who shall cut said
acequia without having obtained said
ermission, shall be deemed guilty of a
misdemeanor, and upon conviction there-
of, i hall be fined in any Bum not less
than one, nor more than fifty dollars.
Hec 9. That it shall be unlawful for
any person to placa in said acequia any
Hood gate or other obstrustion whatever
>r to place over said acequia any struct-
ure or croseing, without first having ob-
tained the permission of the city assessor
and collector or acequia Commissioner,
and any person so offending shall be
deemed guilty of a misdemeanor, and
upon conviction thereof shall be fined
not less than One nor more than fifty dol-
lars.
Sec. 10. T4at all ordinances in con-
flict with thia ordinance be and the same
are hereby repealed, and this ordinance
shall tal^e effect from and after its pas-
sage, aporovai and publication.
