Opera House Friday night to a fair
audience, and the old character of "Si
Ferkins" with its j>reat originality

ing and dramatic story clothed with
the delicious perfume of new-mown

CUy Attorney R. E. Pennington
and Trustee Harry Hayues returned
from Austin Thursday night where
they went to get the tftate school law
which conflicts with the city ordi-
nance to make an exception of the
jcity of Brenham.
They had a suitable bill introduced
and themselves appeared before the
Educational board and explained the
difficulties under which Brenham was
laboring and came away with the as-
surance that the bill will be reported
lavo.ably and will probably pass.
It is hoped that it will for under
the prevent arrangement unless the
matter can be adjust oil in some way
the «chool fund will not be sufficient

year and pay for teachers to handle

ington county.

To Hon. E. il. Sinks, Judge of said
court: C. G. Dement plaintiff com-
plaining of the Houston Printing
Company, defendant, represents that
the plaintiff resides in Lee county,
State of Texas and the defendant Is a
corporation duly incorporated under
the laws of Texas, and has aud main-
tains a main business office in the city
of Houston. Harris county, State of
Texas, and said corporation has as its
officers one E. P. Hill an President,
T. W. House as Vice-President, A. F.
Sittig as Secretary, aud J. L. Watson
as Treasurer, all of whom live and re-
side In the county of Harris, State of
Texas. And the said Houston Print-
ing Company lias its legal domicil in
the county of Harris, State of Texas.
That the said The Houston Printing
Company is now and was on tho 22nd
day of Nov. 1803, engaged in publish-
ing and circulating a certain news-
paper known and called The Houston
Daily Post, Houston Sime-Weekly
Post and lloustou Weekly Post and
that all of said newspaper's has sub-
scribers and were circulated in the
county of Washington, State of Texas
and throughout tho State of Texas.
That heretofore, to wit, in the Hous-
ton Daily Post of Nov. 22nd, 1804 and
the Houston Semi-Weekly Post of
Nov. 2ti, 1894, there appeared the fol-
lowing lauguage tinder the following
heading, to wit:
Giijdings, Texas, Nov. 21, '04.—C.
G. Dement, formerly of Washington
county, aud who was at one time a
Baptist preacher, was jailed last night
on a charge ot horse stealing. His
son-in-law, Joe Holstein, was jailed as
particep criminis. Tho horses alleged
to have been stolen was the property
of J. C. Hlllsmau, of Ledbetter."
That tho said C. G. Dement now is,
and from the time of his birth hith-
has beeu a good, virtuous, hou-
peaceable and law abiding man
citizen, of said State of Texas,
has at all times aforesaid be-
haved and governed himself as such,
until the time of the writing aud pub-
lishing of the talse, scandalous and
notorious libel herein before men-
tioned. That the defendant well
knew of this plaintiff's character aud
good standing, but with reckless dis-
regard of this plaintiff's rights and
willfully and malicious contriving aud
intending to prejudice and dograde
aud injure tho said plaintiff's good
name aud reputation aud hold him up
to aud expose him to public infamy
and to disgrace and eoutempt and
bother and disturb and destroy the
peace aud happiness of said Dement
aud family, did on the said day aud
date aforesaid set out and falsely pub-
lish to the world that the plaintiff
was a horse thief aud was guilty of
horse theft from J. C. Hillsmau and
charged with horse theft.
That iu truth aud in fact this plain-
tiff had no legal charge of any sort or
kind against him, but was'lnjustly
aud Illegally without warrant of law
seized by one Sanders pretending to
act as a deputy sheriff of the sheriff of
Fayette county, Texas, and was forci-
bly placed in the couuty jail of Lee
county, Texas.
That the publication by this defen-
dant that the plaintiff was jailed on a
charge of theft of horses from J. C.
Hillsmau was absolutely false aud
was calculated to and did bring great
shame aud disgrace on this plaintiff
and cause him great grief and distress
of mind to his damage in the sum
of $10,000
Wherefore the premises considered
the nlaintiff prays that this defend-
ant be cited to answer and on a final
hearing he has his damages and gen-
eral and euuitable relief.
