THE petioner sets forth that defendant
Cochrane is indebted to him in thr sum
of $55 09 and interest from March, 1842 ;
that on the IQih day of November, 1841, lie
pledged and mortgaged to him, a certain tract
of land, consisting of nine hundred acres, and
ittiate at the Sun "Marcus Springs in the 1
county of Travis, ni part of the headright nl
defendant Forsyth ; that he ownfd mid laud
by virtue of a title bond, executed bv defend
ant Torryth to defendant Cochrane, which j
said title bond he delivered to petitioner, at j
the time he made and executed the abovc ,
named writing of pledge or mortgage ; tha
defendant Cochrane has failed to pay the said
sum, and defendant Forsyth refuses to make
and execute the said title, as promised i'i tin
said title bond. Petitioner, therefore, prays
that his title may be quieted, or if the writing
obligatory is a mortgage, that the same should
be foreclosed and sold, iind the proceeds : p-
plied to the payment of the demand of ihe
petitioner, or a decree rendered by the said
Court, graining the" laud pledged or mortga-
aged to the petitioner, and Forsyth be com-
pelled to execute a title to petitioner.

.. Browning, deceased, in his lifetime, fnr the
valuable consideration ttf iw. iluiu-.uud dol-
lars, raide nnd executed a cert tin title bond
in the year 1839, Jo make and execute to hint
a title to n certain irae.t of land, known as the
upper half of a certain league of land, .situa-
ted on tha west bank of the Colorado river,
opposite the city of Austin, commencing at
the mouth of Spring creek on the bank of said
river, lying north west of a ten league grant,
and adjoining league seventy, including all the
Utiper half of said league, except two hun
dred acres, to I e taken off the back end of
said upper half, to include half the front of
laid lea rue on 6aid river, the lower line run-
ning parallel to the .upper line of said league,
so us to include in said tract or parcel of land,
two thousand and tweuty-tvrn acres,, heino-the
league granted to one Isaac Decker, as his
head-right, and conveyed by him to Brown
ng. Petitioner further alleges, that the said
Browning in his lifetime, or his administrator
or heirs since then, have totally failed, nedec
ted and refused to execute to him a good and
sufficient title: lie then-fore prays for a spe-
cific performance of said title bond, and prays
citation to the parties above named.

filed his petition in the honorable the
Distriel Court of said County, cnmplairing of
one Colvin B. Emmons as f. Ilows,lo wit : on
the Gib ily ol'Jniiuary, 1838, in the County of
Ri.bertson, to wit : the County of Milam, C.
B. Emmons contracted and agreed 1st. to
select and locate as his own property two
choice leagues of land, in the western part of
the Republic of Texas ; 2nd. to convey by
warranty titles in fee simple, one league of
said land as follows, to wit : the said Farley is
to have choice of said leagues or the same to
be divided, and said Farley to have one-half
of each ; and is permitted to decide, the way
said lauds are to be divided ; 3rd. if said land
is divided into halves, the said Farley to have
choice of one-half and Emmons the other.
The said Emmons agreed localise to be con-
veyed io said Firley, one labor of land, on
which the .-aid Farley agreed to pay the land
office fofn; 5lh. the said Emmons agreed
within six months after the opening of the
general land office of the Republic of Texas,
to make said conveyance. The petitioner
sets forth that C. B Emmons bound himself
t.. pnv snid FarleyUiis heirs, &.C., the sum of
$10,000 as liquidated damages in case ofnon-
perJnrnianee of contract. The petitioner al-
leges that Emmons executed to petitioner a

fact, that an opinion ha been promulgated from the
East, that ihe course pursued by the I'residenl whilst
teaching there, was supposed to have the first men-
tioned result. We incline to the opinion that a di-
versity of studies is calculated to inlieve the mind,
and prevent it from flagging or tiling; and think that
our President can by his present method, impart a
complete education in a much shorter tunc, and at leso
expense, than .t can be dni.p on the old piaetical plan.
We are also well pb-aed with ihp order and decorum
of the scholars, n- d with the internal government of
the school, so far as the sa ne has come under our
knowledge and i.om-i v:.lnn.
We cannot therefore, recommend too highly to Ihe-
attention nf parents and the puhlic in general, tho
school of Mr. and Mrs Montrose, nnd have much ,
confidence .n the prediction, that it must ultimately
fulfill the warmc&t anticipations nf its founders.
