Court of Appeals Passes on
Constitutionality
of Act
Austin, Texas, November 19.-
The court of criminal appeals today
upheld the validity of the permanent
warehouse act of the Thirty-third
legislature in the case of ex parte
Dabney White, from Smith county.
The opinion was written by Judge
Harper, Judge Prendergast approv-
ing. Judge Davidson dissented.
The court held:
"We are of the opinion that the
act does not deal with two subjects
in so far as it relates to the ginning
and warehousing of cotoWn. Both
of these are incident to and neces-
sary regulations to the proper niar-
ketting of cotton, and necessary to
remove the evils shown to have here-
tofore existed, and which enabled-a
very heavy loss annually in the sale
of our principal product. The law
is-not violative of any provision of
the State or federal constitutions,
and should be upheld. And' while
it may not and probably will not
cure all the evils shown by the tes-
timony to exist, yet it is calculated
to, intended to, and will prevent
some of the fraudulent practices of
which many are not guilty, yet from
which all must suffer. We can not
strike down a law because it does
not accomplish all that we think It
should accomplish. If it is within
the authority and power of the leg-
islature to enact, the law must be
held valid. The relator" is romand-
ed."
Notice to Poll Tax Payers.
Upder the Terrell Election Law,
no one can pay the poll tax of an-
other without, a written order, not
even a woman for her husband, nor
I a man for his father, son or broth-
: er, and under a ruling of the United
i States Revenue Department such
order is considered a Power of At-
torney and subject to a revenue tax
|of twenty-five cents, to be paid by
the party giving the order.
(Section 11 of the Washington
County Special Road Law provides
thatevery delinquent poll taxpayer
of Washington county who shall fail
to pay his poll tax, shall be com-
pelled to pay such tax by working
on the public county roads of the
county for three full days.

Harbors Congress.

19.—Every city or town in Texas
that is interested in waterway proj-
ects that will be up for considera-
tion at the forthcoming session of
congress is urged to have one or
more delegates join the party of
Texans who will l?ave Houston on
the morning of December 5 for
Washington to attend the twelfth
annual convention of the National
Rivers and Harbors Congress. May-
or Roy Miller of this city, who with
J. 8. Cullinan of Houston and Colo-
nel Frank P. Holland of Dallas rep-
resent Texas on the board of direct-
ors of the Rivers and Harbors Con-
gress, is now arranging for the
special cars that will carry the Tex-
as delegation, and he urges those
who will attend -to notify him just
as early as possible.
Mr. Miller points out that a de-
termined fight on waterway projects
will be made in both the house and
the senate and he Is very anxious
