morning. When the sheriff and his priso-
ner emerged from the train they
ware confronted by Federal Judge
Gomacjio /and a number of officers'who
nacho and a
demanded the pris<|**r, Sheriff Bills-
brand told them that Smith had besn
turned,ovi^t to him by /Bovernor Carillo,
who held his receipt for tha fugitive.
He would not tarn over the prisoner, but
if they wanted him. they would have to
take him by fore* Tbs officer! then
forcibly took Bmt^h from Sheriff Hills-
bread, and plaesdjFitt in solitary confine-
meat at. the Juarez j ail. The arrest was
mads by tha Juarez authorities under
habeas corpus proceeding*, which had

Mr. 8er)ts, attorney for Smith. The habeas
corpus proceeding* ire based upon the fol-
lowing: The charge against Pmitb, for
which our authorities are trying to extra-
dtte him, la conapiracy to ro>. It is
claimed that the treatise between the two
qountrise only provides for an extradition
In oertain well defined oases, and that,
while tha offense of robbery is one of
those named in the treaty, the offense of
conspiracy to rob is not an offense for
which extradition can be claimed. This

On the other side it is claimed that if
Smith could not be extradited, why was
he pieced in jiil at Juarez, instead of be*
ing turned loose, as is .generally the caae
