Judge Walthall was yesterday occu-
pied In hearing the evidence of the
Lindsay case on the application of
Mrs. L. M. Hcmley, formerly Mrs.
Lindsay, asking that a receiver lie ap*
pointed.
The Issues are being tried by the
court The evidence so far submitted
Is practically, so far as the property
Is concerned, an elaboration of that in-
troduced at the divorce proceedings.
When court adjourned the testimony
had not been completed, and the trial
will probably take all Monday.
Mrs. Hemley claims a community
Interest in tbe furniture and personal
effect* contained in tbe Excelsior
hotel. It Is further claimed that the
petitioner’s mother loaned Dr. Lind-
say $3,000 and that part of the said
money has never been repaid.
At the time that the divorce decree
wns granted the property question was
not then determined, but left to be set-
tled at some future time. In the appli-
cation for a receiver It Is alleged that
petitioner's Interests need protection
and that a receiver under the provis-
ions of the statute should lie appointed
to take charge of the assets.
Dr. Lindsay claims that the property
has been sold to Mrs. Rachel Denny
for a valuable consideration, and that
he owns little or no Interest In tbe cor-
poration now In control of the hotel.
On tbe other hand, It Is contended
by the plaintiff that if any transfer has
taken place It has been made to de-
fraud her of her rights. *
Dr. Lindsay wns on the Bland yester-
day afternoon and examined at length
regarding the present and past finan-
cial transactions of the Hotel Excel-
sior. At the present he said it was
not a paying institution, and the en-
terprise was barely meeting current
expenses. He testified that as regards
the claim for the money borrowed
from Mrs. Rutland, Mrs. Hemley's
mother, he had paid it back in va-
rious ways, sometimes giving her
money in small amounts and some-
times paying or being responsible for
bills she had incurred. He also
claimed Hint a large sum had been
given back In the way of medical at-
tendance and hoard. The doctor said
that he wns unable to remember a
number of the Items.
He was still on the stand when court
adjourned.
Guaranty Trust Co. Will Be Aid to
Community.
The Guaranty Trust company of El
Paso Is going to prove a most helpful
Institution for this community. It has
already started many children, women
and young men to saving their nickels
and dimes. The company distributee
a small oxidized copper safe which
can only be qpened at the bank. The
possessors of these banks drop some-
thing Into them every day, and in a
short time each will have a bank ac-
count and their deposits will be draw-
ing interest at the rate of 4 per cent
per annum.

News reached the city yesterday
morning that Unde John Julian had
lieen stricken with paralysis at Doug-
las. Arlz.. and was there In a serious
condition. The report of the unfortu-
nate occurrence came tn a telegram
to T. B Collier. Mr. Julian's partner.
It stated that the entire right side
had been paralyzed and that he had
lost the power of speech. When
stricken down Uncle John was on Ills
way to Cananea to visit Charles Julian,
who Is quite 111.
In the first half. Thq game was excit-
ing from start to finish.

In the case of Hugh Mackay ve. the
Corralltos compauy. Judge Walthall
granted the motion of the plaintiff to
strike out the statement of facts which
was thought hud been agreed upon
by the respective parties to the suit.
The case was tried last January and
the plaintiff was given a judgment for
$1,682, including Interest. From this
judgment an appeal was taken to the
higher caurt.

WINNIE DAVI8 MEMORIAL HALL
Athens, Ga, Nov. 1.—The laying of
the corner alone today for the Winnie
Davis Memorial Hall wa* made a gala
day for the State Normal School. The
exercises were conducted under the
auspices of the Georgia division of the
Daughters of the Confederacy and
those In attendance Included promt
nent persons from many parts of the
state.
The memorial hall when completed
will serve as a dormitory for the girl
students of the school. The movement
for It* reaction waa started by the
Daughters of the Confederacy four
years ago. The different chapter* of
the organization have succeeded In
raising nearly $11,000, to which has
been added $4,500, the gift of the gen-
era! educational board. The total coat
of the building will be *21,000, and the
remaining amount of money will bo
collected by the Daughter* of the Con-
federacy before the building Is com
pleted. After Its completion, the hall
will be furnished throughout by differ,
ent chapters of the society.

Petition for Pardon.
A petition Is being circulated for the
pardon of Charles Raymond, who Is
now serving a term of twenty-five
years for robbery by assault.
The prisoner was tried and convicted
in El Paso, the case having been
brought here on a change .of venue
from Reeves county.
The grounds of the petition are that
at his trial Raymond waa unable to
procure the presence of material wit-
nesses. The defense set up at the trial
was that Raymond was not the person
who committed the robbery and the
prosecuting witness was mistaken In
his Identification.
Petition Denied.
An application tor a writ of habeas
corpus In the case of Wllltam Howard
has been denied by Judge Walthall.
The case has already been set for trial
and will probably come up this week.
Howard Is charged with assault to
rob. Arrangements are being made
to release him on bond.
Fight for Child.
A complaint baa been sworn out
against Henry Chris charging him
with forcibly taking away hie child
and concealing H from Its mother. He
Is accused of aggravated assault.
The child belong to the defendant,
but divorce proceedings are pending
between him and his wife.
