Mr. Lamb on the other hand while ad-
mitting the lose of New York claimed
Ohio Indiana and Nebraska for the dem-
ocratic column. With Mr. Lamb were
Roger C Bull! van of Illinois. Lrey V ooTJ-
son of Kentucky. J. W. Tomlineon of
Alabama and a number of local demo-
crats none of whom in the abeenoe of
complete returns would admit the defeat
of Mr. Bryan.
In the city at large the triumph of the
republicans was taken for granted when

newspaper had strung up large white
canvases on which were thrown election

Broadway. In Harlem and Brooklyn.
Two hours after the polls had closed
several newspapers Issued extraa announc-

appealed to every democrat to go to the
polls and the result was a larger vots
than usual. The republicans were also
active and the returns show that Taft
polled a heavier vote than Roosevelt In
the last presidential election but their
activity did not reduce the usual demo-
cratic majority

o'clock Wednesday morning Indications
war that Nebraska had gone democratic
by a plurality not far from 10000 for
Bryan and a plurality eoaroely lea for
Shellenburger for governor. The result
was a surprise and a dlsappolnement to
republican rrtsuiag-ers who. while admit-
ting that the state was doubtful on ths
National ticket confidently expected the
State ticket to be elected.
The tremendous gain for Bryan tn ths
city of Llnooln was the sensation of the
election. Not only did Mr. Bryan reverse
a republican plurality of 1600 In his home
city but be carried It by a plurality of
something over tjOO. The vote in Omaha
uss also a surprise. Returns outside of
Lincoln and Omaha show an average
democratic gala of 8 to 10 per cent If
this Is maintained throughout Bryan has
won by a little over 9000 aside from Lln-
ooln and Omaha and Shellenbarger Is
elected by practically ths same plurality.

ka probably has gone democratic by a
decisive plurality with not enough re-
turns on the governor on which to make
an estimate. Bryan has made slight
gains In the country precincts and la
th cities the democratic gains are heavy.
Bryan carried Lincoln by 100 overturn-
ing a normal republican plurality ot 1600.

plurality estimated at 78.000. The con-
gressional delegation with one district to
hear from probably will remain about
the same nine republicans and two dem-
ocrats. The legislature will elect a United
States senator to succeed Isaac Stevenson
and will be overwhelmingly republican
the returns Indicating 73 republicans. 21
democrats and S social democrats In the
assembly an d 77 republicans 4 democrats
and 2 social fTemocrats In the aenate.
While Taft carried the city of Milwaukee
by about 1S00. Aylward (Dem.) for gov-
ernor led Davidson (Rep.) by 1800 votea

the $800000 ilbe'l suit filed by Governor
Haskell of Oklahoma sgainst Mr. Hearst
In the BUte court of Nebraska In Omaha
be transferred to the Federal court was

Heasst's local attorney.
The basis of the petition Is that as the
parties to the suit reside In a State other
than Nebraska the case can not be tried
In the State court. There is legal ques-
tions Involved in this as to whether such
a case can bo transferred to 11 Federal
court.

"I would rather try the case In a Fed-
eral court If It had . Jurisdiction for the
reason that the State laws of Nebraska
do not allow any punitive damages and
the Federal court does. Half the amount
we are suing for $300000 represents
