Nova Scotia’s Supreme Court
legalizes same-sex marriage
The Supreme Court of Nova Scotia legalized
same-sex marriage last Friday, following the
footprints of courts in British Columbia,
Manitoba, Ontario, Quebec and the Yukon
Territory.
Eighty-two percent of Canadians now live in
jurisdictions that extend marriage to gay and les-
bian couples.
“This is a great day for Nova Scotia,” Bob
Fougere, coordinator of the Nova Scotia
Rainbow Action Project, said. “Slowly but sure-
ly, the civil institution of marriage is being
opened to same-sex couples, no matter what
province they are living in.”
Justice Heather Robertson of the provincial
Supreme Court declared the federal definition of
marriage, which implies only opposite-sex pairs,
to be an unconstitutional violation of Canada’s
Charter of Rights and Freedoms.
She redefined maniage as “the lawful union of
two persons to the exclusion of all others.” The
ruling is binding throughout Nova Scotia.
The legal challenge to Nova Scotia’s law was
brought by two gay
male couples and
one lesbian couple.
Neither the
province nor the
federal government
fought the lawsuit
in court.
The Liberal gov-
ernment, led by
Prime Minister
Paul Martin, is
expected to move to
legalize same-sex marriage nationwide later this
year or early next year. The government is await-
ing a nonbinding opinion from the Supreme
Court of Canada, which is reviewing draft legis-
lation granting marriage rights to gays and their
same-sex partners.
Same-sex marriage is still unauthorized in
Alberta, the Northwest Territories, New
Brunswick, Newfoundland, Nunavut, Prince
Edward Island and Saskatchewan. A pending
court case in Saskatchewan could be decided
soon, according to the Associated Press.
Fifty-seven percent of Canadians support giv-
ing gays and lesbians the right to marry their
same-sex partners. Thirty-eight percent are

opposed, according to a July survey by
Environics Research Group and the Center for
Research and Information on Canada.
Elsewhere, same-sex marriage is authorized in
Belgium, the Netherlands and the U.S. state of
Massachusetts. Numerous jurisdictions in the
U.S. and overseas have enacted domestic-part-
nership or civil-union laws that grant same-sex
couples many, most or all of the rights and obli-
gations of marriage.
Canadian Member of Parliament
acknowledges his homosexuality
Another member of the Parliament of Canada
has acknowledged that he is gay, the Toronto
newspaper Xtra reported Sept. 16.
Mario Silva, 37,
who represents a
blue-collar area of
Toronto, discussed
his homosexuality
in a Toronto Star
profile, the report
said.
Silva told Xtra he
had no problem
with the newspaper
mentioning his sex-
ual orientation.
“I have a lot of respect for the writer. I also
think that the article was very tastefully done,”
Silva told Xtra.
Silva’s district includes Ontario’s largest group
of immigrants. It is also home to Toronto’s
Portuguese community.
Other openly gay or bisexual members of the
Canadian Parliament include Scott Brison, Libby
Davies, Real Menard and Bill Siksay.

Robinson resigned earlier this year after stealing
an expensive ring at a jewelry sale.
France grants legal status to
lesbian couple, their 3 daughters
France has recognized a gay family for the first
time, granting legal status to a lesbian couple and
their three daughters who were bom via artificial
insemination, the Paris daily Le Monde reported
Sept. 22.
A Paris judge allowed “Carla” and “Marie-
Laure” to establish a legal link between each par-
ent and the children and granted them joint
parental authority.
Before the ruling, Carla had won the right to
