SENATE BILL 200 ON SECOND READING
On motion of Senator Patrick and by unanimous consent, the regular order of
business was suspended to take up for consideration SB 200 at this time on its second
reading:
SB 200, Relating to the continuation and functions of the State Pension Review
Board.
The bill was read second time.
Senator Whitmire offered the following amendment to the bill:
Floor Amendment No. 1
Amend SB 200 as follows:
(1) Add the following appropriately numbered SECTIONS and renumber the
SECTIONS of the bill accordingly:
SECTION . Section 801.102(a), Government Code, is amended to read as
follows:
(a) The board is composed of seven [ee] members.
SECTION . Section 801.106, Government Code, is amended to read as
follows:
Sec. 801.106. TERMS OF OFFICE. Members of the board hold office for
staggered terms of six years, with the terms of two or three members, as appropriate,
expiring on January 31 of each odd-numbered year.
SECTION . Section 801.1061(a), Government Code, is amended to read as
follows:
(a) It is a ground for removal from the board that a member:
(1) does not have at the time of taking office the qualifications required by
Section 801.103 [e-r4-.4];
(2) does not maintain during service on the board the qualifications required
by Section 801.103 [er-8041-4];
(3) is ineligible for membership under Section 801.1021;
(4) cannot, because of illness or disability, discharge the member's duties
for a substantial part of the member's term; or
(5) is absent from more than half of the regularly scheduled board meetings
that the member is eligible to attend during a calendar year without an excuse
approved by a majority vote of the board.
SECTION . (a) A person who is serving as a member of the State Pension
Review Board appointed under Section 801.103, Government Code, on the effective
date of this Act continues to serve until the person's term expires.
(b) The governor shall make appointments to fill vacancies on the State Pension
Review Board so that board members' terms of office expire in compliance with
Section 801.106, Government Code, as amended by this Act, and, if necessary for
compliance with that section, a person may be appointed to a term of office that
expires in less than six years.
(c) The term of a person who is serving as a member of the State Pension
Review Board appointed under Section 801.104, Government Code, expires on the
effective date of this Act.Tuesday, April 2, 2013
