the Local Situation

making a general Inspection ot the
property and terminals In Galveston
and also the Galveston Houston
Henderson properties The party con

ident and general manager of the In-

souri Kansas Texas and J W Al-
len and A E McDowell general
freight agent and general superintend-
ent of that line
They are seeking some method
whereby tho cotton congestion of the
present season may be avoided in the
future and are listening to suggestions
from local freight officials and gener
ally studying the situation in order to
ascertain what is required to keep
their lines clear hereafter
Very probably tho matter of ap-
pointing a temporary general man
ager for tho Galveston Houston
Henderson to act during the absence
of Mr J H Hall will be taken up by

JUDGE LANDIS OVERRULED DE-
MURRERS TO EIGHT INDICT-
MENTS AGAINST STANDARD

Chicago Jan 3 Judge Landls of
the Federal court this morning over-
ruled demurrers to eight indictments
against the Standard Oil company re-
fusing them a repetition of the Immun-
ity bath given the packers Demurrer
as to two Indictments was sustained
but the trial ot the cose upon eight
counts must proceed at once
The ruling is a victory for the gov-
ernment in tho first stages ot the
prosecution ot the corporation for re-
ceiving concessions equivalent to re
bates in remission of storage freight
charges
The trusts attorneys contend that
the enactment ot the new law extin-
guishes the penalties for offenses
against the Elklns lawt
HOT SPRINGS IS FLOODED
Two Days Downpour Caused Damage
to Property and Blocked Traffic
Hot Springs Ark Jan 2 The heav-
iest rain ever known fell here all of
last night and by reason of tho wash-
ing away of bridges and houses In
the northern part of the city the mer-
chants along Central avenue were dam-
aged to the extent ot at least 75000
Central avenue which is the principal
thoroughfare of the city was for
hoars a seething river The water
wits waist deep on a man and no one
attempted to cross the street except
in avehicle Three houses on Water
stttset were washed out as also wan
the grandstand at Whltingtdn park
AtIeast twenty bridges were swept
aVnr and In the lower part of the city
ThJ lumbermen lost many thousands
f < j ffetfot lumber All cellars along
Central avenue were flooded to depths
ot ten feet and all goods stored there
were destroyed or damaged There
were no trains in or out ot the city
after the early morning trains arrived
The Rock Island attempted to send its
train ont at 2 oclock but after pro-
ceeding about five miles was forced
to return to the city Tho Little Rock
and Hot Springs Western attempted
to send out no trains as the tracks
were under six feet ot water for n dis-
tance ot COO yards a short distance
from the city it will be impossible
for tho railroad companies to learn
the extent of their damage until the
water snbsldes
Tonight the rain Is still falling and
the worst may yet come

troops of tho Twentyfifth Infantry on
account of theiralleged participation
in the shooting up of tho town ot
Brownsville Texas Senator Lodge
has recently state d that ho would not
oppose the Inquiry Even after tho
resolution is adopted tho committee
will still bo In position to deny the
investigation as the resolution is not
mandatory but no one believes that
such a course will be taken There Is
already discussion as to whether the
committee will go to Texas or do Its
work In Washington but the general
Impression is that witnesses will be
brought to this city and that all tho
sittings will be held here

duce certain rates according to the de-

tional convention reconvened today A
provision providing that a writ of ha-
beas corpus could never bo suspended
and that the military shall bo sub-

to the Federal constitution Unless
public safety requires It in case ot re
bellion or invasion was voted down
Former Governor Thomas of Colorado
in a letter criticised the alleged undue
authority given the military in Colo
rado as resulted during tho strike
trouble and advised against such
clause in the Oklahoma constitution
