ARB to begin hearing
tax protests in June
Property owners in the Rains
County Appraisal District will have
an opportunity in June to protest
proposed appraisals of their prop-
erty for local taxes. The district’s
appraisal review board (ARB) will
begin hearing taxpayer protests in
June.
After the ARB completes its
hearings and approves final prop-
erty appraisals, local governments
will use these appraisals to set 2000
tax rates.
The ARB is a group of citizens
who live in the appraisal district and
are appointed by the district’s board
of directors. Their responsibilities
and qualifications are outlined in
the Texas Property Tax Code.
Property owners may protest to
the ARB any of the following
appraisal office actions:
* the appraised or agricultural
value of the property;
* unequal appraisal of the tax-
payer’s property compared to other
property in the district;
.• inclusion of the property on the
appraisal records;
* denial of a partial exemption,
such as a homestead exemption;
* denial of agricultural-use, open-
space, or timber productivity
appraisal;
• determination that agricultural
or timber land has had a change of
use and is subject to a rollback tax;
• identification of the taxing unit
or units in which the property is
located;
• determination that the taxpayer
is the owner of the property; or
• any other action of the appraisal
office that adversely affects the
property owner.
Linda Norell, chief appraiser for
the district, outlined the steps a
property owner must take to file a
protest. First, the property owner
must file a written notice of protest
that shows why the owner is
protesting to the ARB. The taxpayer
must file this notice by May 31 or
within 30 days after the appraisal
district mails the taxpayer a notice

later.
If a person leases property and,
by contract must pay the owner’s
property axes, then the person leas-
ing may protest the property’s value
to the ARB, if the property owner
doesn’t p-otest. If the ARB sends a
property owner a notice of any
other kind of change in the
appraisal records, or if the chief
appraiser issues a notice for a prop-
erty omitted in the prior year, the
property owner has 30 days from
the mailing date to file a protest.
Official forms for a notice of
protest were included with ap-
praisal let.ers to property owners
and also are available at the
appfaisal dstrict office. “A protest
letter from the taxpayer is also
acceptable, ’ Norell said, “as long as
it identifies the property owner and
the property protested and indicates
dissatisfactbn with some decision
or action of the appraisal office.”
Each protesting property owner
may offer evidence or argument,
either in person or by filing a sworn
affidavit witk the ARB. A property
owner may tppoint another person
to present the protest by filing an
Appointment of Agent form with the
appraisal disrict. Property owners
should know that the ARB has no
authority ovei tax rates or spending
and will not hear protests on these
topics.
The ARB will schedule hearings
as property owners file protests and
will tell them the time, date and
place of their individual hearings at
least 15 days before the hearing
date. Property owners will also re-
ceive a copy of the State Comp-
troller of Public Account’s pam-
phlet called Texas Property Taxes:
Taxpayers' Rights, Remedies &
Responsibilities a copy of the
ARB’s procedures and notice of
available evidence at the appraisal
office to be preiented at the hear-
ing.
Norell said that hearings will be
held for two wteks and that the
ARB expects to approve the final
appraisal roll by July 20. State law
requires the ARB to review and
approve the appraisal records by
July 20, or when tot more than five
percent of the total property value
in the district remains under protest.
Those protesting their appraisals
should not contaat ARB members
outside the hewing, the chief
appraiser stressed.Each ARB mem-
ber must sign an affidavit that he or
she has had no contact about the
protest with a property owner or the
appraisal office staff before the
hearing. ]

Greenville Technical Center. Cathy, who is from Miller Grove, is the wife of
Randy Stracener and the daughter of Bob and Florence Elliott of Sulphur
Springs. April, who is from Birthright, is the wife of Thomas Jenkins. Jr. and
the daughter of Pattie and Larry Lennon of Miller Grove and granddaughter
of Tommie and Norwin Lennon of Emory.
The Point City Council met in
regular session on May 9. The
council canvassed the results of
May 6, 2000. city election for
mayor and two council members
and approved the minutes of the
past meetings.
Robert Lake of Rutherford Taylor
and Company presented the audit
for fiscal year ending December 31,
1999. The council approved the
audit report for fiscal year 1999.
Nell Jones discussed curfew for
the city of Point. Mayor Clifton is
to talk with Sheriff Wilson and see
if he will help.
The council discussed a letter
received from ihe Sabine River
Authority on renewing the city's
water option for water from Lake
Fork. The option was renewed. The
council increased the water tap fee
to $1:250 and the sewer tap fee to
$1,250. They also approved pur-
chasing a water-billing program at
the cost of $2,600.
The council discussed the city
backhoc needing repairs This will
be discussed at next month's meet-
ing. They approved hiring a con-
tractor to do backhoe work or rent- ,
mg a backhoe until the next meet- •
ing. ;|
The council discussed making an '
application to TDHCA for a granf *
for water lines and fire hydrants.
The motion was rescinded on the
grant through TDHCA to read
"Have Mr Hayter let us know if we
can get a grant for a pressure tank
and other improvements to the
water treatment system."
The council approved overtime
for the month of April.
The council approved payment of
bills as presented.
The council approved the motion
that the city secretary stay in closed
executive sessions unless there is a
conflict between another employee.
The meeting adjourned at 9:45
p.m.

Our family had a great Mother’s
Day. It was very beautiful outside
and we had lunch at Tommy and
Brenda Malone’s house. We had
burgers and all the fixings and lots
of great desserts. We hope everyone
enjoyed the day as much as we did.
Betty Tidwell went to Houston to
stay the weekend with her grand-
children and then went to Fort
Worth to babysit a great-grandchild
Monday through Wednesday. She
returned to Point on Thursday. She
had an enjoyable time but is
extremely tired.
With the Sick
James Woodson had knee surgery
on May 10 at the Terrell hospital
and has been moved to rehab for
seven or eight days. He is doing
well and we all wish him the best of
luck with his knee.
Billy Romine had some heart
trouble and was admitted to the
Terrell Hospital for a few days and
then released to go home. He has to
follow up with a visit to his regular
doctor. We all hope things go well.
