Congressman Carter applauds settlement

Last Tuesday, U.S. Representative John
Carter applauded the City of Waco and six
Central Texas dairies for settling a federal
lawsuit that has been going on since April
2004.
According to Carter, the Waco suit was
based on the Comprehensive
Environmental Response, Compensation,
and Liability Act (CERCLA). City officials
claimed that that the manure from dairies
was polluting the Bosque watershed, which
flows into Lake Waco - the city’s source for
drinking water.
The CERCLA, also known as
Superfund, was enacted by congress in Dec.
1980. This law created a tax on the chemi-
cal and petroleum industries. It also provid-
ed broad federal authority to respond direct-
ly to releases or threatened releases of haz-
ardous substances that may endanger public
health or the environment.

The CERCLA states-that per-
sons responsible for releases of
hazardous waste will be liable.
Waco officials cited that dairy
waste produced nutrient phos-
phorous that caused algae
blooms which contributed to
taste and odor problems in Lake
Waco drinking water. In April
2004, the city included 14 area
dairies in its litigation.
John Cowan, executive direc-
tor for the Texas Association of
Dairymen, said that the TWsuit
was unnecessary and that water
quality was actually improving
before the lawsuit was filed.
“Water quality has improved
substantially in the Bosque
watershed over the last decade,” Cowan
said.
He feels this litigation was a waste of

resources for both sides. Cowan noted that
environmental restrictions for dairies would
have been much higher had the
lawsuit not been filed.
“Permit applications in the
watershed still will be consid-
ered under the existing state
regulations adopted in July
2004,” Cowan said. “Ironically,
the lawsuit actually prevented
the region's dairy farmers from
operating under stricter rules in
these TCEQ regulations.”
Overall, however, it seems
that all parties involved are
happy that a settlement has been
made.
“I am pleased that the city
and dairymen have reached an
agreement that will allow our
Central Texas dairies to contin-
ue operations and their valuable
contributions to the local economy, while
keeping the region's water clean,” Rep.
Carter said.

The Brazos River Authority
this week sent letters to cus-
tomers in the upper and cen-
tral portions of the Brazos
basin, advising them of Stage
1 Drought measures or a
“drought watch.”
The move comes as a result
of the basin's prolonged dry
weather conditions. The pur-
pose of the Stage 1 Drought
Watch is to make the public
aware of the current drought
situation and promote careful
use of water.
The authority's drought
contingency plan provides for
several lake level triggering
criteria, based on three levels
of potential drought condi-
tions. Lake levels in the upper
and central portions of the
basin have reached the Stage I
trigger, indicating a drought
watch. Drought precautions
are now in effect for Aquilla
and Proctor lakes.
“In stage one, we are alert-
ing our customers and the gen-
eral public that the current
drought worsen if weather
conditions do not change,”
said Senior Engineer David
Wheelock. “At this time, we
are not asking our customers
or the public to begin cutting
back on water usage. We are
simply alerting them that
should current conditions con-
tinue into the spring and sum-
mer months, voluntary or pos-
sibly mandatory water restric-
tions may be necessary.”
Should Stage II triggering
criteria be met, both authority
customers and the general
public will be asked to volun-
tarily reduce water consump-
tion by approximately three
percent.
The Brazos River Authority
contracts with the Corps of
Engineers for water supply
storage space at Lake Proctor,
which is Dublin’s primary sup-
plier of water.

TCAA to hold banquet
Executive Director July Danely recently announced the Tri-
County Agribusiness Associations annual membership meeting,
banquet and fundraiser scheduled for Tuesday, Feb. 7 at Legends
Country Club.
The evening will kick off with an ag mixer and silent auction at
6:30 p.m. with complimentary beer and), wine. A steak dinner with
“all the fixin's” will begin at 7 p.m. followed by a live auction and
the annual report.
“We are making plans to do even more in 2006 to promote the
industry that is so vital to our economy,” Danley said.
The annual meeting agenda includes a review of 2005 accom-
plishments, goals and event plans for 2006, recognition of five and
10-year members and an election of new directors.
Nominees include Chad Alieva of AgTexas Farm Credit, Bob
Haske of KSTV radio and Ronda Utke of Gore Bros. Who are cur-
rently serving on the board, as well as Kyle Masters of Bruner
Motors.
TCAA members may nominate additional candidates from the
floor during the meeting. Members may vote by mail if not able to
attend.
Tickets for the banquet are $20 each or $ 18 each for a table of
10 or more. TCAA members are asked to RSVP by Wednesday,
Feb 1. Members will be able to send payment by mail or pay at the
door.

Another week has rushed by
and we will meet at Perry Hall
again on Tuesday. Time seems
to go so fast for us as we get
older. •
Last week we all quilted on
another beautiful quilt. Some
of our group knows so much
about quilting and also about
the patterns to piece. All this
causes us all to enjoy being
together each Tuesday for a
few hours. Some of our group
have been quilting for years
and some of us haven't done
this as long. However, we all
enjoy it. I still say how much it
helps to ease the arthritis in our
hands as we work.
How wonderful the rain we
received last week and we are
hoping for more this week.
We all wonder if we will con-
tinue to have this warm weath-
er. Some little plants are com-
ing up in our yards as they
always do in early spring.
Wonder if they are too early.
The way time is going, we
will soon be busy mowing our
yards and planting flowers and
all the work to be done. As
some of us get older, we have
to have lots of help and we are
so lucky to have them. We all
know how lucky we are to live
near our friends and also living
in Dublin. We all have so
much to be grateful for.
We ask all of you to come
down to see us at Perry Hall on
Tuesday morning. We eat
lunch at 11:30, clean up and go
home. Also on the second
Tuesday of each month we
have Tina with Stephens Home
Health with us. She Checks our
blood pressure and our blood
sugar and she will be with us
on the 14th of February. That
day we will also enjoy sharing
Valentines Day with her. We
would love to have you come
see us.

situation presents a unique learn-
ing opportunity for firefighters

don't want to miss this opportuni-

them in a training environment

use for teaching aids.
